Obama administration poised to challenge Arizona immigration law

The White House is expected to file a lawsuit next week.

A White House showdown with the state of Arizona over its tough new immigration law is likely to unfold next week, when the Obama administration is expected to file a lawsuit aimed at blocking the state's bid to curb illegal immigration on its own, according to people familiar with the administration's plans.

Arizona officials are girding for the legal challenge. The state has raised $123,000 in private donations to defend the law, according to Gov. Jan Brewer's office. Money has come in from all 50 states, in donations as little as $1.

Obama administration officials declined to reveal the basis for the suit. But legal experts say the challenge is likely to include the argument that in passing the law, Arizona violated the Constitution by intruding on the federal government's authority to regulate immigration.

AZ Governor Jan Brewer will not give in to Obama on 1070 out of both conviction and political considerations. Her popularity in AZ is sky high, mainly due to her feistiness on 1070. If she does back down, I shall be shocked.

LOL! That’s Ginger the Labradoodle. She’s the best dog that ever owned me, and I can’t remember a time when I wasn’t owned by a dog.

I highly recommend these dogs—great temperament, very little to no shedding, and they make excellent family dogs, as they love kids!

This is so sick and wrong—a huge majority of taxpayers support Arizona's right to protect her borders and yet we taxpayers have to PAY for Komrad Obama and his running dog shyster Holder to sue them for it!!!

And there is no Constitutional prohibition of States to enforce them, e.g. bank robbery's, kidnapping, drug laws, etc.

You got to feel sorry for whatever Judge gets this case though, talk about the hot seat!

If Arizona loses then I think all the border states should sue the federal government for all the costs associated with illegal aliens since the feds have failed to do the job required of them.

AZ should deduct from federal tax receipts all cost they incurr due to illegal entry into the state. I don’t see BO winning being that AZ isn’t encroaching on fed jurisdiction. They turn all suspected illegals over to the feds for disposition of the suspect.

I’ll take pleasure in watching BO and co lose this one. BUt they will probably get the demons to change fed law the way they are going after campaign finance. It would be nice to watch the pubs boycott the next SOU address.

Isn't this protected by the "interstate commerce" clause? You know, the one-clause-fits-all that liberals use to justify every unconstitutional tic they foment.

If they are filing next week, they must have already picked the courtroom and have a very friendly judge ready to hear the case. The judge has probably been offered a cabinet position in his future.

If this makes it to the supreme, and Obama takes the line of cutting off federal highway fund etc to states that over ride federal authority, I hope the supreme tells him that it must apply equally, and cut off funds to all sanctuary cities. After all, a sanctuary city is taking the federal law into your own municipal hands, the grounds for this case.

That is just what they are counting on. The left wants to divide the nation even further, they are about identity politics.

If they can get it on the news each night, how the right “hates mexicans” they will be ensuring the illegal vote. Then comes amnesty, and they are banking on all those former illegals to have the memory of an elephant, keeping them in power for the next 20 years.

They are fast losing middle class / middle aged and elderly whites, the independent vote is dwindling, the black vote is starting to break a tiny bit, and they need to shore up their vote. Their current policies will never appeal to the taxpayer, their future plans for socialism will never appeal to the taxpayer, therefore, they need to bring in a whole new generation or two of welfare recipients who they will own wholly through federal and state benefits.

Aaah ... wouldst that the Supreme Court would step in from the git-go and hear this entire case, from the opening arguments onward.

There are so many Constitutional issues involved in this single lawsuit that it will — must — hain’t no doubt gonna — end up before the Sleeping Nine. So why wait?

Blow this one into the open now. Let the public hear both sides in this one.
