Kagan, OTOH, has a paper-thin record as a practicing attorney, has never been on the bench and has spent almost her entire career in academia, where she was the least published attorney to ever become dean of Harvard Law. I would be surprised if Kagan gets 65 votes. Facts which --unfortunately--are seldom mentioned by the Republicans. Not for nothing is she called "Obama in a pants suit."

The argument might have some. weight if we we were talking about a cabinet position. But this is a nomination for a judgeship not for an executive position.
