From what I’ve read, WVa law in the instance in quite clear already.

The law says that candidates for the special election are to be chosen in the next scheduled primary election (the 2010 one already happened in May) and are voted on in the next general election, which I would have thought would be November 2011, rather than 2012.

Primaries are held every other year, so the next is May, 2012. I think that the governor is starting to get antsy about waiting that long, but doesn't want to look like he is pushing for it.
