Police: Intoxicated man shot after attempting to enter wrong home (TX)

HOUSTON – Precinct 4 deputies said an intoxicated man was shot early Monday after he attempted to force his way into the wrong home.

It happened in the 25500 block of Twister Trail at Falcon Trail in northeast Harris County.

Deputies said a man mistakenly went to the wrong house around midnight and began banging on the front door. The homeowner told the man to leave, but the man refused, saying it was his girlfriend’s house.

The man then went to the back door and tried to force entry, according to deputies. That is when the homeowner retrieved his gun and shot once through the door, hitting the man in the stomach.

The man was taken to Ben Taub hospital in stable condition.

He sure as hell shouldn’t be charged if this story is accurate. It’s Texas but it’s Houston so I wouldn’t be surprised.

I have always heard that being a drunk is bad for your health, but I didn't know that lead poisoning was the problem you would have.

The article refere to the man who did the shooting as “the homeowner”, but you make a valid point. It IS still possible that the intruder’s girlfriend lives there: the homeowner’s sister, cousin, daughter, cheating wife, etc.

That reminds me of a funny story from 35 years ago. I was dating a woman and we were driving from north from Florida. We stopped in the Philadelphia suburbs and stayed with her mother for a couple of days. One evening, we went out to eat with an old high school girlfriend of hers who lived with her parents in nearby Levittown, PA.

After dinner, we took her home, and she had some difficulty finding her home... we backed up and down several houses while she noted subtle differences between the homes (basketball court in back, awnings) which wer very much the same. After some puzzlement, she finally said, "Oh, I know, we're on the wrong street!". The streets, by the way, were all alphabetically named, and ran on long block between a loop road.

I never knew how those suburban folks found their homes - I still have problems when visiting friends in modern developments with rules on how the homes and properties must look.

I grew up mostly in Philly row homes, to the "untrained eye" they all looked the same

Texas Penal Code 9.31

Subsection (a) Except as provided in Subsection (b), a person is justified in using force against another when and to the degree the actor [he] reasonably believes the force is immediately necessary to protect the actor [himself] against the other’s use or attempted use of unlawful force. The actor’s belief that the force was immediately necessary as described by this subsection is presumed to be reasonable if the actor:

(1) knew or had reason to believe that the person against whom the force was used:

(A) unlawfully and with force entered, or was attempting to enter unlawfully and with force, the actor’s occupied habitation, vehicle, or place of business or employment;

There's a Russian film that runs every year around the holidays, sort of their version of "It's a Wonderful Life" or that one with the BB gun. It involves a guy going out drinking with friends at a sauna and ending up in the right apartment in the wrong city. "Irony of Fate".

They recently did a modern remake, but the protagonist still doesn't get shot.

I actually had a similar incident while stationed in Norfolk, Va. but the guy got lucky.

I lived on the beach at the time, I woke up and went in the living room and some guy was sleeping on the couch... I called my roommate to find out who he was, he said what guy... next thing you know the guy woke up with a .45 Auto being pressed to his forehead... he then heard four words; "Get The F*#K Out", wide-eyed he damn near broke his neck running out the door.
