US Justice Department to review BART shooting

LOS ANGELES -- The U.S. Department of Justice will conduct an independent review of the Johannes Mehserle case in order to determine whether or not the shooting merits federal prosecution, according the department.

"The Justice Department has been closely monitoring the state's investigation and prosecution," the department said in a statement.

"The Civil Rights Division, the U.S. Attorney's Office, and the FBI have an open investigation into the fatal shooting and, at the conclusion of the state's prosecution, will conduct an independent review of the facts and circumstances to determine whether the evidence warrants federal prosecution."

Congresswoman Barbara Lee, D-Oakland, said she has been in touch with the justice department.

"I remain in close contact with the Department of Justice and will continue to work with them, the family and the community in the days ahead," she said in a statement.

The statement also addressed local reactions to the Mehserle verdict.

"Understandably there is grave concern in the community," Lee said. "However, during this time our city must come together peacefully so that we can begin to heal."

Lee said she stands with Oakland Mayor Ron Dellums, the City Council and community leaders in supporting people who want to express themselves.

I'm normally pretty hard on LEO, but the involuntary manslaughter verdict seemed like a correct ruling.

The guy obviously meant to go for his taser. Those BART guys deal with sh!tstains on a daily basis so I'm sure he had quite a bit of pressure on him. Let's not forget Grant was no angel.

Nothing financial from the Justice Department.

Remember that the officers in the Rodney King trial were acquitted, so then went after them, and convicted them, on federal civil rights charges.

They want more than 2-4 years and the Obama’s feds offer recourse.

So Holder is now getting involved? Well that’s a big comfort. I consider this solidifying the black vote.

I wish Obama and his ilk would have stepped in this fast after Deepwater Horizon blew up.

I wonder about that too.

There are so many laws on the books that they would seem able to conjure up some charges that are different enough to circumvent the double jeopardy defense.

People on the far left have always wanted a national race war...a real one with riots going on all across the country. They think this will "purge" the country of injustice.

Question is...will Obama resort to this kind of tactic to get the sort of energy going that he needs in the runup to November. Nothing else seems to be working for him. He may just try it.

You have a good point.

We have so many laws out there, that often contradict each other, that you can almost pick and choose when you want to use one to further punish someone. This is very dangerous. This leads to chaos.

Doesn’t apply. He’ll be tried for violating the decedent’s civil rights, not for killing him, even though the underlying facts are the same. The Feds have done this before.

You'd never get that impression from the posters around Oakland.

This case is a good example of the Darwin Award. Wrestling with an armed police officer seldom has a good outcome.

The people on the far left that support obama not only want a national race war, they want anarchy. The black panther types, azlatan types, and the types who destroy their neighborhood when their basketball team wins are being purposefully agitated. While at the same time, those that don’t riot to get what they want are also being purposefully agitated. The media is actively involved with this. Look at how they portray the tea partiers as nazi’s, racists, bigots and every other insult they can throw at them. We have a group in the white house that believe in exploiting chaotic situations. “Never let a crisis go to waste”. So, since obama has been in office, they have been setting the table for multiple scenarios for chaos. They have been weakening our economy, putting huge numbers of people out of work. They have been intentionally insulting our allies while flashing weakness to the bad guys of the world. Now we are in a very hot summer leading up to a national election. These people are about not just winning the elections, they are about ending the game entirely with them in power.
My point here is that we are dealing with diabolical people with no emotional attachment to this country or it’s people. They are intent on eliminating all political opposition (amnesty). If they get their way, taxpaying Americans will be so outnumbered, the elections won’t even have to be rigged to keep them in power.
This summer is going to be precarious because of the stakes. Keep watchful and protect yourself and family. This may get rough.

It doesn't apply because of a legal principle called the dual sovereignty doctrine. Essentially, the Supreme Court held in a 1920s (United States v. Lanza) that because the State(s) and the federal government are separate sovereign, each can prosecute a person for respective violations of each sovereign's law, even for the same exact act.

So, what happens is 4 cops are acquitted of beating Rodney King in state court, but then are tried and convicting in federal court, for federal civil rights violations stemming from the same exact crime.

Well, we know, from testimony re the Black Panther voter intimidation case, that the objective of the Obama Justice Department is to hound, persecute and deprive the civil/voting rights of white people. So this should be no surprise. This is a political lynching, a clear case of double jeopardy. Any white person who votes for Obama again should have his head examined

The Federal Statute arose as a way to deal with a bunch of state level KKK acquitals back in the 60s [the bombings, lynchings, etc.] which were a result of jury nullification.
