US Justice Department to review BART shooting

LOS ANGELES -- The U.S. Department of Justice will conduct an independent review of the Johannes Mehserle case in order to determine whether or not the shooting merits federal prosecution, according the department. "The Justice Department has been closely monitoring the state's investigation and prosecution," the department said in a statement.

"The Civil Rights Division, the U.S. Attorney's Office, and the FBI have an open investigation into the fatal shooting and, at the conclusion of the state's prosecution, will conduct an independent review of the facts and circumstances to determine whether the evidence warrants federal prosecution."

Thank GHW Bush for this travesty. After the Rodney King mess, he allowed his DOJ to pursue the officers involved in total abrogation of liberty’s bedrock principles against double jeopardy. I’d rank that decision as almost as bad as his policy of going hat-in-hand to the UN for permission to defend our ally Kuwait, which treaty and common decency required us to do. Both these decisions established highly regrettable precedence.

If this happens it would be true repression. The guy was CONVICTED. He was convicted of the offense most people thought had been committed when they saw the video. He will be sentence and go to jail. The jury was convinced that the evidence did not support a murder charge. Were the Justice Dept. to file additional charges it would just be “piling on” because of the race of the defendant.

Correction, the enemy of SOME people. Others seem to have a permanent “Get Out of Jail FREE!” card, immune from any constraint whatsoever.

The media totally ignored the facts that the late Oscar Grant was terrorizing people on the BART train with his handgun, and was aggressively resisting arresting and going for items in his pockets while being cuffed. That doesn’t excuse his shooting, but there is NO recognition of the degree he himself escalated the situation.

I thought the verdict was actually pretty much on target. Mehserle made a tragic mistake, has been convicted of manslaughter, and now faces a firearm enhancement to his sentence.

And now the “DOJ” (justice? really?) wants to jump in with some sort of race based prosecution? Sounds a lot like double jeopardy.

Who in their right mind would want to be a cop in the East Bay now? And how much safer will we be after we’ve turned the city over to thugs?

Obviously, but I bet there's a work around. He was prosecuted for the act of killing, and found guilty of involuntary manslaughter. However, he hasn't been prosecuted for violating the victim's civil rights. They can pile on by calling it a separate charge.

From what I’ve read, a defenseless man was shot dead.

And I think that to be wrong, and don’t believe that the charge should have been anything less than first degree murder.

On the other hand, I think that there’s a lot to be said for shooting rioters and looters.

None of my opinions count for squat until I decide that I’ve got to take the carbine out for use, of course...

You'd think so wouldn't you? Unfortunately, the law recognizes a legal fiction, that since the States are separate jurisdictions from the Fed, then trying the same person twice for the same actions in those two different jurisdictions doesn't violate the douple jeopardy clause. Of course it's nonsense but it was established to fight the Jim Crowe justice in the south during the '50s and '60s.

He went through a trial. He was found guilty.

Now, the politicians who have used the judicial system to perpetuate all kinds of injustice on us, have decided that he wasn't found guilty enough. They want a do-over so they can have their way with him.

That's how they do it in third world countries. In America, this is a fairly new phenomenon.

Correct me if I’m wrong, but doesn’t a murder conviction require some sort of premeditation? Doesn’t apply to this case, where the cops were responding to a report of an armed assailant. They had no idea who is was.

As far as the BART cops knew, Grant still was in possession of his handgun, and appeared to be going for it while he was resisting, so “defenseless” wasn’t in the mix, either.

No winners here. Two lives destroyed. And now the DOJ wants nothing more than revenge.

So there goes that Leo Therrell deal where he said that the Shabizz character WAS ‘prosecuted’ and has an injunction from going near THAT polling station for 2 years.

I guess already being convicted of a crime isn’t a reason to not have to face federal charges for the same crime, unless you are white.

This reminds me of the situation surrounding the handing down of the O.J. Simpson criminal verdict.

George Stephanopoulos wrote, in a memoir of his years in the Clinton Administration, that at the time the verdict was announced (I seem to remember it as October 3, 1995) President Clinton, Jamie Gorelick and Stephanopoulos were in the Oval Office of The White House watching the live coverage come in.

He wrote that Gorelick had, in her hands, a prepared announcement that the DOJ was to commence an investigation of the LAPD, and he indicated that she was prepared to go to the White House press room to make the announcement should O.J. have been convicted. The White House was concerned about the possibility of riots breaking out if O.J. was convicted. and clearly they felt a palliative investigation would dampen the response.

The unusual aspect of this was that while they were loaded up and ready to launch against the LAPD, they didn't lift a finger after the acquittal to investigate the federal bases for criminal prosecution of Simpson for federal crimes arising out of the double homicide (interstate flight, use of interstate communication in furtherance of a crime, violation of the civil rights of Ms. Brown, Mr. Goldman, etc., etc. etc.) after the CA prosecutors botched their case. So, unfortunately there is a clear precedent for very political use of the Justice Department. By Democrats.

There was a very similar case in Madera, California in 2002. Officer Marcie Noriega shot Everardo Torres through the heart with her .40 caliber Glock, thinking it was a taser. The drunken Torres was handcuffed in the back of a police car at the time. He was struggling and trying to kick out the car windows.

Officer Noriega was not even charged. The Justice Department did not get involved.

The difference? Hispanic / Hispanic in the 2002 case vs. White / Black in the current case.

Why are we paying extra taxes for State Government when it is obvious Obama and his pal Eric Holder want to run the whole show.

I didnt have to see this to know what would happen under an Obama Presidency, I went around telling everyone what to look for and was ignored.

So a Black Panther criminal can stand on a corner and shout “Kill they babies”, and Holder lets him off for intimidating voters with a weapon, but a cop is convicted of manslaughter and Holder wants to investigate because he doesn’t think the charge was enough? We really do live in a racist country.
