Man did not pull gun on police at Costco, lawyer says

A lawyer representing the family of a man fatally shot by police at the Costco in Summerlin denied police reports Monday that the man had pulled out a handgun and pointed it at police.

Erik Scott, 39, had at least one handgun with him at the time of the shooting Saturday, but also had a concealed weapon permit, attorney Ross Goodman said.

I don’t know the whole story on this but I do know better than simply take the word of the victim’s attorney.

Costco should be held fully responsible as having employed the officers to gun down a lawful citizen; if it had been a Gangs’ta it would have been profiling and no one would have done anything, cause it’s okay to kill cracka`s.

Although the Officer’s and Department should bear some responsibility; I would want to see Costco’s and Police videos, hear both the 911 recording and the dispatch audio, and see the individual self-written citizen reports plus Officer Reports then decide.

Maybe to educate yourself you should read the original story with the statements of a half dozen or so witnesses, one of whom was 7 ft. from the victim.

I don't believe they were CostCo policemen (I'm pretty sure CostCo doesn't have a private army). They were Las Vegas Police. Lawsuits (probably warranted, based on what I've read so far) will be paid by the taxpayers. If this homicide was due to negligence and incompetence, the police in question need to be fired. The CostCo clerk who caused this event also needs to be fired.
But other than that, I can't see CostCo's financial liability. Yes the clerk was an overreacting idiot, but at least she was unarmed. Other overreacting idiots employed by the City (or State), were the ones who gunned the citizen down.

I was involved in the shooting of a burglary suspect at my home last year and I easily surrendered my handgun from the back of my hip to the initial officer on the scene without having to touch it so it is indeed possible the dead man never touched his concealed handgun.

My weapon was returned to me at the end of the initial investigation the same afternoon as I was within my rights and the senior investigating officer was very courteous and professional the whole time. But he did keep the spent casings though.

I had a cop pull a gun on me once when I was pulling out of a parking lot once. He apparently was walking up behind the car and asked me to stop and I didn’t hear him. I heard him the second time when I saw his gun.

apparently I looked like someone who was wanted and considered dangerous. I was only a couple of blocks from the jail so my friend drove my car down there while we got it straightened out.

She should be sued. She started the ball rolling for no good reason. It resulted in the man's death. Costco should get sued to give these business an insight into controlling gunbanning activism. The police need to be made to understand they are not above the law. The man was compliant with the law. He gets killed for it. If a gangsta gets legitimately killed, a black mob descends upon the the law abiding.

Why the hell would you pack heat anywhere.....it's called self defense, we all know criminals never frequent schools, shopping malls, Church's, streets, stores, gas stations, ad infinitum.....you should never be ready or capable of self defense, especially in cases where you least expect it....

Where Las Vegas Metro PD is concerned, you might want to learn a new set of assumptions.

If victim attorneys were such lying SOBs in Vegas, Vegas taxpayers would not be paying so much in compensatory damages.

As it is, those of us who were around NV when the shall-issue ccw legislation was going through the legislature can tell you what liars Vegas Metro PD is. We can also tell you how they flouted the ccw law for years thereafter.

I agree with LRM's post #30. Include the clerk in the lawsuit.
This is just wild speculation, but I suspect the clerk's message was one bordering on hysteria, and as a consequence the policemen were 'amped' up when they came to the store - and had already drawn conclusions that there was a wild man in the store waving a gun around. If that's the way in played out, the clerk and policemen all need to be fired and sued.
But in my opinion the CostCo corporation shouldn't be in the suit (not that the lawyers will keep them out), because I don't see how they can be held accountable for a clerk that breaks down at the sight of an evil firearm (who knows how she reacts when she reads the 2nd Amendment in the Bill of Rights? Probably curls up into a ball and hides under her/his bed...). Its only a clerk position - its hard to see how CostCo could have prevented this one. The Police, on the other hand - they are supposed to be trained, and able, to handle these situations.

I carry in the stores all the time. What the he** is a CCW for if not to carry in the places most likely to get you shot(usually by a criminal)? What a stupid statement. The trick is to make sure it is always, and I mean ALWAYS, hidden from sight so some hysterical idiot doesn’t panic.

I do understand what you are saying, it just is that the store manager is responsible as well. From reading the story, it sounds like the store manager ordered the store to be evacuated.

My question has been, based on what?

Did the police request this, or did this store manager get informed by the slandering clerk, and made this decision WITHOUT checking the facts?

Costco could well be culpable in this situation.
What did this store manager know, and HOW did he know it?

I didn't catch the Store Manager angle.
You're right, if he was ordered by the Police to evacuate the store, then CostCo is probably in the clear. If he made the decision on his own, then CostCo probably is culpable.
I suspect I won't hear much about this in the local news here (unlike the Messinger/BART wrongful death case - which was broadcast non-stop), so I'll check back on the FreeRepub to see if there are any updates (e.g., Video tapes released)...
