The family of a Wharton firefighter who died battling a massive egg farm blaze is fighting to keep his widow from receiving death benefits, arguing that the 37-year-old had found out his bride of two years was born a man.

Thomas Araguz III separated from his wife after learning her history two months prior to being trapped in the fatal July 3 fire, according to attorney Chad Ellis, who is representing Araguz's parents in the lawsuit.

"He was distraught. It was extremely difficult and embarrassing for Tommy," said Ellis, who added that there is no will for the estate, which will be substantial since the fire captain died in the line of duty.

Gay deception and he still feels entitled to the estate.

Hey, folks, she probably went to court to legally change her gender to female. However, I still think she committed a fraud by not telling him before they married.

This is true, but it doesn’t change the fact that the good Captain has been slamming a guy for nearly two years. Such information can be the cause of much amusement among the troops and some really serious pyschic damage to the Groom. Hell, imagine telling your mother that your wife is a he. That will certainly twist your mind and self image.

So this was “extremely... embarassing” to their son and the way his parents decide to honor his memory is by “outing” the whole sordid affair??? Oh, yeah -— there’s money involved.

If he died intestate, his children will more than likely be awarded a substantial portion of his estate and any settlement anyway. The parents and ex-wife are just trying to impose their disapproval on the new wife’s “transition” and get their hands on all the money themselves.

Texas law states that the sex you were at birth is the sex you are today and no amount of surgery or makeup will change it and same sex marriages are not legal in Texas.

He certainly is. Usually the only give away is the hands. Met a couple of real stunners many years ago in New Orleans. Had that creepy feeling about the broads. Then I noticed their hands. I smiled and quickly left the bar. It really pays to stay semi-sober while on a toot.

Dying without a will (intestate, to use the legal term) means that you have no say in the distribution of your estate and it all goes according to state law and the named beneficiary(ies) stated on insurance and pension papers. Of course, this potentially fraudulent marriage may bear on how the judge settles the estate but the starting point is clearly stated in the law.

The courts cannot recognize the marriage to begin with. There goes the claim to the estate.

The barbarians are at the gate attacking the legal system at every turn to “norm” same sex marriage outside of the legislature.

Right now some Massachusetts wed lesbians are seeking an Austin divorce claim in league with an activist judge.

Thomas Araguz learned during a custody dispute with his ex-wife last spring that 35-year-old Nikki Araguz, whom he married in August 2008, was allegedly born as Justin Graham Purdue. Ellis said he was unsure when Nikki Araguz may have undergone a sex-change operation, but the lawsuit claims she changed her name in the mid-1990s to Nikki Paige Araguz.

Isn’t the correct term “splitadicktomy” rather than “lopadickoffme”? My understanding of the procedure is they split the penius to create two wings of the manufactured vulva. If that doesn’t make you sit up and holler, I don’t know what will.

She also would not discuss her birth name or whether she was connected to the criminal history of Justin Graham Purdue, which includes at least three theft convictions.

Nikki Araguz, a native of northwest Houston, ran an unsuccessful bid for Wharton mayor against a volunteer firefighter this past spring, drawing 30 percent of the vote. She closed her magazine, Wharton County Living, immediately following her husband’s death.

From the article his ex-wife told him. The real question is did he know all along and just feign outrage when the ex started circulating the news to the other firemen? Its real hard to have a secret in most Fire Departments. That and there is no prospect for transfer. Makes me wonder if the Captain found the egg factory fire a excellent opportunity to cash out and cash in all at once?
