Lawsuit lessons (Arizona)

One broader lesson people need to take away from the legal wrangling over the Arizona law: Any enforcement provisions of "comprehensive immigration reform" that Congress might pass would be tied up in the courts for years. As my colleague Steve Camarota wrote recently:

Any employer verification system will be challenged in court. So will any efforts to coordinate immigration enforcement with local police. Immigration lawyers also will fight every effort to detain more of their clients. Building new fencing and dealing with environmental and property rights issues at the border will involve legal battles. While in time these things almost certainly will pass legal muster, court injunctions and proceedings will hold up enforcement for years.

So while the amnesty would go into effect immediately (because, after all, the ACLU supports amnesty), the other provisions, regarding E-Verify and border enforcement and the like, wouldn't go into effect for years, if ever. So almost by definition there can be no grand bargain of amnesty (and increased immigration) in exchange for tougher enforcement; the enforcement must not only be legislated before any discussion of amnesty, it must be fully litigated, too.

Starting tomorrow, it will be legal to carry concealed in Arizona without needing a permit.

This ruling will encourage many to start. It has reached a point I wouldn’t hike in many areas without a gun...but maybe this judge doesn’t get out of her gated community much!

This is nothing more than legalistic fraud to undermine America and support an invasion of replacement population; no inalienable rights, no American standards means no America, just EU-Light verging Balkanization...now, take a guess at why this is taking place so willingly by the political class.

It's a CLINTON appointed Judge - what do you expect?

THIS Arizona law is in perfect harmony with current FEDERAL law. This is outrageous. What she struck down was what gave this law teeth. Officers would have had the right to SEE proper documentation for being here if they suspected the person was ILLEGAL and would not allow ILLEGALS to work here without the proper paperwork.

This is a tragedy. It will wind up at the U.S.S.C.. The outcome is ify.

Maybe they need a visit to the ALAMO.

Veri-Check works well for EMPLOYERS!

It's easy and about 97% accurate. The small 3% can be straighted out. There is no excuse for Arizona law NOT be allowed to go through. It protects our country. ILLEGALS are BREAKING our LAWS at the FEDERAL LEVEL. Arizona law is in complete harmony with present FEDERAL LAW.

Of course the ACLU and UNIONS want manesdy for their growing ranks. They will get CHEAP labor and have another inocme source. It is UNIONS that are protecting ILLEGALS as well as the ACLU.

Every networks and show especially sports is so biased toward O and the Dems it is sickening. A lot of it is incredibly subtle.

After Roe v Wade, the whole issue was settled all across the country. Done deal. Nothing more needs to be said.

The recent gun control case establishing RKBA as an individual right? Weeeeeeeelllll, you need lots more litigation to figure out what the Supreme Court meant by that. Very tricky. It could years before we can decide what the Second Amendment means ...

Arizona Law on immigration? Another very tricky case. No action can be taken until a whole lot of court cases are heard on that.

If Arizona state troopers cease enforcing laws on federal highways? Or if all Arizona cops stop enforcing federal drug laws? I think it will take about 24 hours for the Federal Government to quash that. Done deal. Settled case. The State must bow to the feds. No discussion required.

We're all just serfs. Our overlords decide what we can do. Our opinion means nothing.

Which is why Jan Brewer should tell the court to go to HELL and instruct the state police to enforce the law!! MOREOVER, she should ask for citizens VOLUNTEERS to secure the border, receiving pay from the state. Armed with instructions to shoot to kill as necessary. And enlist citizens groups to “check” for citizenship as desired and remove illegals by bus.

This travesty should be NUMBER 1 on the republican party November hit parade! The lawlessness increase in Arizona, thanks to illegals, should be pitched by every republican candidate. The Clinton appointed judge should be EXCORIATED!! And republicans should PLEDGE IN BLOOD to seal the border if given control of the house and senate. They would win seats in unprecedented numbers. But of course, the loafer wearing party members, from Newt to Steele, would NEVER consider such a strategy. And that’s why republicans will pick up about 20 house seats and maybe 5 in the senate. No power, No control. No nothing.

No surprise. After all, it was an over-educated judge and typical political elitist who doesn’t even live there who made the decision.

This is a GRAND opportunity for the governor to simply say “Look, the United States government has ignored this flood of foreign-born people using Arizona as its highway into the American heartland for twenty years. Today a federal judge ignored our state sovereignty and the duty of the Governor of Arizona to protect the people of Arizona. I am ignoring this ruling because my first duty as governor of Arizona is to protect the citizens of Arizona, and American citizens who visit or do business here. I am ordering the Arizona National Guard to the Mexican Border, and will continue to have our police enforce this immigration law which was passed with a huge majority support by the legally elected legislature of the State of Arizona, and is supported by 90% of the citizens of Arizona.

The United States Government and our president have abdicated their first responsibility, which is ‘to protect and defend the citizens of the United States’. Since they neither have the will or courage to do so, we will protect the citizens of Arizona.”

She would become instantly more popular than Sarah Palin.

Yes, but that's the wrong question. The right question is:

Did Sen. McCain vote to confirm her!!!

She was confirmed 10/3/2000. Congressional record reports the confirmation without mention of any vote, so I'm guessing it was by unanimous consent. Does Johnny have any cover? It's four weeks until the primary. How much can JD make out of McCain's judge in that time?
