DOOM Approaches in Arkansas [For Dem Blanche Lincoln (and other AR Dems?)]

The latest Rasmussen totals for AR-Senate are brutal for the incumbent (65/27 Bozeman/Lincoln) and the RCP average isn't much better. Which is not precisely news but it does lead to a couple of observations.

First, given this type of lopsided Republican dominance in the Senate race, is it legitimate to say that either the Democratic incumbent in AR-04 (GOP candidate Beth Anne Rankin) or the Democrats trying to retain AR-01 (GOP candidate Rick Crawford) and AR-02 (GOP candidate Tom Griffin) have any kind of advantage in the general election? There is a very real possibility that Arkansas is about to flip from 3-1 DEM/GOP to 4-0 GOP/DEM, which is something that hasn't happened since (I think) the tag-end of Reconstruction.

Second, did you know that the state legislature in Arkansas is dominated by the Democratic party in both houses? That might not be all that true after November.

Third, it's currently conventional wisdom that incumbent Democratic governor Mike Beebe (GOP candidate Jim Keet) is too populuar to be shifted. Maybe so. Then again, maybe not: at least some of the people showing up to flip the Senate seat and the House ones are not going to be inclined to make an exception for any Democrat.

All in all, while I agree that the Left sent the Democratic party a pretty powerful message in the Arkansas Senate primary, I'm not sure that the text of that message was the one that the Left wanted to send...

What most Americans do not know about the current legal challenges against ObamaCare: the constitutional resolution depends exclusively on how the case for adjudication is written.

Texas Attorney General Greg Abbott says often that if the case is presented as a judgment about the individual mandate requiring individuals to purchase a certain private sector product or service, “we win.”

If, on the other hand, the case is presented as a matter of whether the federal government can control health care, as it does with Medicare, “we lose.”

Georgetown law professor Randy Barnett, counsel for Angel Raich in the Supreme Court’s Raich case, coined what he called “the dirty little secret of constitutional law” – whether a petitioner will find relief in federal court “depends on which accurate description a court chooses to accept.” He sums up: A “court may rule however it wishes simply by choosing how to describe the right.”

It is this court’s discretion on how to phrase the constitutional issue that makes U. S. District Judge Henry Hudson’s recent rendering so vital to the case. He refused to dismiss a Virginia lawsuit challenging the constitutionality of the federal health care law.

Note that he focused on the issue of the individual mandate, not on the matter of whether the federal government can control health care. “While this case raises a host of complex constitutional issues, all seem to distill to the single question of whether or not Congress has the power to regulate – and tax – a citizen’s decision not to participate in interstate commerce. Neither the U. S. Supreme Court nor any circuit court of appeals has squarely addressed this issue.”

One reason she’s doing badly is that the liberal nutroots in AR are literally outraged at her and don’t care to vote for her in November (they call her a DINO or crypto-Republican, which is ludicrous). They wanted her ousted in favor of Lt Gov. Bill Halter and thought Halter would have a better chance of beating the GOP nominee. The problem, however, is that Halter is a moonbat Socialist himself while Blanche is just basically a liberal with occasional moderate tendencies. If Halter had replaced Blanche, he’d be running a more aggressive candidacy, but for every vote of the nutroots that he got, he’d turn off a mainstream AR voter and would probably lose by almost as wide a margin.

Here is the KeyHouseRaces.com summary for the Arkansas House races that are in play. Tim Griffin is in very good shape. It's a little tougher race for Crawford but he will win if he can compete with Causey in the fund raising battle. If you are a loyal Freeper who wants to see the Republicans take back the House then you could do some real good by sending $10 to the Rick Crawford campaign.

This is absolutely amazing. I don’t think I’ve ever seen a non-scandal tainted incumbent trail by a margin like this. It makes me wonder about other races in Arkansas.
