New evidence undermines feds' case against Arizona

ICE investigators also interviewed top federal officials involved in illegal immigrant cases in Arizona. They found an "excellent" working relationship between the sheriff's office and the feds. ICE talked as well to federal prosecutors in Phoenix, who described the cases brought by Maricopa County as "high quality."

In all, it's a quite positive assessment of an operation that just six months later would come under the Justice Department's microscope for alleged civil rights violations. It also lends indirect support to Arpaio's contention that the Justice Department investigation is politically motivated.

A tidbit of information contained in other government documents released under the Freedom of Information Act also suggests politics may be involved. Arpaio's lawyers found a March 11, 2009, e-mail, sent just after the Justice Department investigation was announced, from an ICE employee to John P. Torres, then the acting assistant secretary of ICE. "Did you see this?" the e-mail said, attaching a news report on the investigation. "Yes," Torres responded a few minutes later. "Interesting politics at play."

Standard procedure for democrat fascists. I recall when it was pointed out that there had been multiple vists to Waco shortly before the Feds raided it and none had been able to find evidence of violations. That's OK, they need a pretext, they'll make one up. The Sheriff in AZ isn't some child molester they can rely on 'marry' anoher little girl next week, he's a duly authorized State offcial. Will the HRT have his house surrounded next week and be telling us they've seen a "pattern of abuse" on his part? Will they be telling us they are only concerned with the children of the illegals and fear for their safety as long as this Sheriff is at large?

These idiot fascist democrats can't even think up a new trick but every time a new crew of thugs gets their turn to put the public on the rack we're told that these are "the best and the brightest". It's odd how the best or the brightest changes every two years, but you know how it is, all those media types must know what they're talking about.

Did Holder even send in a matchbook cover and buy himself a fake law degree or was his skin color sufficient to skate on through school and then simply be granted whatever he wants without a single test of his knowledge ever coming up to muddy the water?

As a deputy attorney general in 2000, Eric Holder’s advocacy of a presidential pardon for international criminal Marc Rich proved beyond doubt that Holder is a plain and simple crook.

How many billions in contraband moves north and south while the White House plays its games?

The report, crammed with acronyms and bureaucratese, is not light reading. But struggle through it, and the key sentence is this: “The OI and DRO supervisors consider the conduct and performance of the MCSO ... officers to be professional and meeting the requirement of the MOA.” Translated, that means officials from the Homeland Security Department’s Office of Investigation (OI), along with officials from the Detention and Removal Operations office (DRO), concluded that the Maricopa County Sheriff’s Office (MCSO), in its handling of illegal immigrants, acted in a professional manner and complied with a memorandum of agreement (MOA) under which the government gave them the authority to enforce federal law. That agreement included a ban on racial profiling.

Holder was also involved in Clinton’s decision to reduce the criminal sentences of 16 members of the Boricua Popular Army, an organization that has been categorized by the FBI as a terrorist organization. The clemency request was initially opposed in 1996 by U.S. Pardons Attorney Margaret Love. When Holder was elevated to Deputy Attorney General in 1997, he was asked to reexamine the issue by three members of Congress. In July 1999, Holder recommended clemency to Clinton with a report from then U.S. Pardons Attorney Roger Adams that neither supported nor opposed clemency. A month later, Clinton granted the clemency. According to The Hartford Courant, the clemency was unusual because it was opposed by the FBI, the federal prosecutor and the victims. According to the newspaper, it was also unusual because, before the commutations, the Boricua Popular Army members were not required to repudiate their actions, and they were not asked to provide any information concerning the whereabouts of Victor Manuel Gerena, a co-conspirator and one of the FBI Ten Most Wanted Fugitives, or the millions of dollars stolen by the group in a 1983 robbery of Wells Fargo in West Hartford, Connecticut.

Malone’s sister was Vivian Malone Jones, famous for her part in the Stand in the Schoolhouse Door which led to integration at the University of Alabama.

This was not a Republican-contrived controversy. Time reported at the onset of the hearings:

But most see this as a source of bipartisan outrage. Republicans and Democrats alike were dumbstruck by the Rich pardon. The federal prosecutors who indicted Rich are especially livid, particularly because, by definition, Rich appears to be ineligible for a pardon: He never took responsibility for his actions or served any sentence. The congressional panels were called to investigate the path to Rich’s pardon — which, as various documents seem to indicate, did not follow usual channels. In testimony Wednesday before the Senate Judiciary Committee, U.S. pardon attorney Roger Adams says when the White House sent over Rich’s name for pardon consideration — only a few hours before the president was due to leave office — there was never any mention of Rich being a fugitive.

It appears the federal government (Homeland Security) has certified (MOA) the state of Arizona (Sheriff Arpaio and his officers) to enforce federal immigration laws.

Yes, Eric Holder was No. 3 in the Clinton Justice department, and as Hillary's personal representative, was the real head of DOJ, leaving Janet Reno as the token drunk/idiot/lesbo figurehead. Justice was one of the cabinet agencies that Hillary demanded from Bill. Bubba's only real decision at DOJ involved him ordering in the Defense Department to provide "technical assistance" to all the civilian alphabet agencies.

Hillary had veto power over promotion of generals, but she could not sign the order for military action at Waco.

Holder may still be an affirmative action parasite, but he's been around the block with exercising "yes we can" power for quite a while already.

I think it's close to the time to stop paying any Income Taxes. The Justice Department is going to be so tied up suing the states for phantom crimes against illegal immigrants that there won't be any resources left to go after tax cheats.

With millions upon millions no longer having sufficient income to need to pay income taxes I'm sure they have a few drunks and dopers on the payroll left to handle the cases that courts only listen to as a formality prior to making you pay.

I believe you mean, it can’t be rescinded. And that is true. Clintbilly did nothing illegal there. Immoral might be another question. The complaint is that normally Presidential pardons follow a protocol intended to screen for seemliness, and somehow Rich’s case managed to skirt the protocol big time.

Yup...we can't take it back, and BJ can't be held legally responsible either. Might as well be water under the bridge.

Of course, if it turned out Holder had lied in the Marc Rich affair, would that be a federal crime? And if it were, could he still be prosecuted? Probably some statute of limitations there...I suspect hell will freeze over before justice is done...but we will still remember.
