Attorney says Fort Hood (Nidal Hasan) hearing should be closed (nothing to see here, move along)

...Defense attorney John Galligan wants next month's Article 32 hearing for Maj. Nidal Hasan (nih-DAHL' hah-SAHN') closed to the public, including the media and victims' relatives. An Article 32 hearing is similar to a civilian grand jury proceeding.

... Galligan says he's worried about Hasan's ability to get a fair trial if the Article 32 hearing set for Oct. 12 is kept open.

Hasan, an Army psychiatrist, is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5 shootings in a building on the Texas Army post.

Judge Roy Bean presiding would say:

Your goig to get a fair trial. We’re going to find you guilty and hang you later today. Do you have anything to say? If you do I’ll hold you in further contempt and we’ll carry out the sentence much earlier.

Brfore it is over, they will decide that he had a First Amendment right to shoot the people and the officer that shot him will be prosecuted for committing a hate crime.

We live today in an upside dowm world where right is wrong and wrong is right. never thought I would live to see it, but, here we are.

Article 32 hearings are only similar to grand jury proceedings if you are a reporter trying to explain things you don’t really understand. They both determine whether there is sufficient grounds for a further trial (court martial in the case of the military). However, article 32 hearings were always open to any member of the command in my 20 years in the Navy. Most people just had other obligations at the time they were held, or had no interest in the event. One summer, 30 or so of us Midshipmen on a training cruise were ordered to be at an Article 32 hearing as a training event. Not a very exclusive event.

They both determine whether there is sufficient grounds for a further trial (court martial in the case of the military) and an Article 32 hearing can result in punishment, unlike a grand jury outcome. However, article 32 hearings were always open to any member of the command in my 20 years in the Navy. Just got word that Galligan's whining about having the proceedings closed has been denied by the judge, also the autopsy reports on the victims will be admitted, and another psych exam by a different head doctor has been ordered.

No death penalty for him. Then he gets to be what they consider a martyr. He can work the rest of his life cleaning the dog pens at an animal shelter or shoveling pig #%$* at a hog farm. With a female guard to tell him what to do. He’d off himself inside of 6 months.

Hasan and any like him should be tried exactly by the same
standard they used when they decided to commit Jihad.I think
using them as target in shooting range— or maybe dressing them in all white robes then requiring them to submit to having their foolish head lopped off might improve the situation.

Yes and what about prosecuting to the fullest extant of the law those responsible for 9/11 and the attack on the USS Cole.

Hang em all. NOW! Right after we give them a military tribunal fair trial.

Please hang him or shoot him on u-tube for all mooslim sympathizers to see. I mean...I realize that he before the trial is only the “alleged” killer. At least no one is referring to him as “the gentleman...”

While I am certainly no expert, I do not think an investigating officer, the official at a Art 32 hearing, can punish-only commanders can adjudicate non-judicial punishment, and only a courts-martial (with either soley a judge in summary proceedings or a jury in other types (genreal, specific BC etc) can convict of crime.

If they are allowed to be open, then fine, so what, if they are closed, same-same. I have been involved in a few as a commanding officer or as a witness, and I gave no thought as to whether it was open or closed. The people who needed to be there were so ordered or invited at government expense if not government/military members. Of course, they were not of the visibility this case is.

The outcome of this event will be that the investigating officer will recommend to the General C-M convening authority (commanding general of either FT Hood/III Corps or the next CG) to proceed with a genreal courts-martial.
