Koch Industries Lawyer to White House: How Did You Get Our Tax Information?

Lately, the White House and its allies have been drawing attention to the political activities of libertarian billionaires Charles and David Koch. In an August 9 speech, President Obama singled out Americans for Prosperity, a free-market political group founded by David Koch in 2004. In the wake of the Citizens United Supreme Court decision, Obama said:

"Using a great deal" of research by the left-wing Center for American Progress, the New Yorker's Jane Mayer reported in the magazine's August 30 issue that the Kochs are "waging a war against Obama." Reason's Nick Gillespie argued that Mayer's report was nothing more than "sly innuendo and revelations as lame as they are breathless," but that hasn't stopped top Democrats from blasting the Kochs for funding the Democrats' political opposition.

Democratic Congressional Campaign Committee chairman Chris Van Hollen said in a September 10 TV appearance that "Americans for Prosperity which are the Koch Industries ... did well under the Bush administration economic policies," which is why AFP is opposing the Democrats. In a September 16 speech, President Obama again singled out Americans for Prosperity. Even Jimmy Carter took a whack at the Kochs last week.

While the attention is unwanted for the Kochs, if somewhat expected, a lawyer for Koch Industries now tells THE WEEKLY STANDARD that the administration may have crossed a line by revealing tax information about Koch Industries. According to Mark Holden, senior vice president and general counsel of Koch Industries, a senior Obama administration official told reporters at an August 27 on-the-record background briefing on corporate taxes:

Besides Obama's tax snooping, another issue is that his administration wants all business income to be taxed twice, at both the corporate level and when it gets passed on to shareholders. Partnerships are just tax shelters in his view.

You are right. That is at the root of that guy’s comment. Talk about a major blow to the economy and employment. Such a move would raise unemployment to 33%.

These guys make the Nixon people look like amateurs. They know that the MSM has their back and that they control both houses of Congress and so they can get away with this stuff with impunity, particularly when the Pres. and AG are black and therefore any criticism is “racism”. Koch Industries is a privately held company, so it makes no SEC filings or other disclosures unless it wants to. It’s tax status is private information. If a private tax preparer had done this it would be a federal crime.

Everyone take a deep breath. Koch Industries is incorporated somewhere. You can look up companies in the state in which they are incorporated and see what type of corporation they are. Here is podunk Iowas you can do this vis the web. This is public information. The article didn’t say they didn’t pay taxes, it said they didn’t pay “corporate” taxes, as they’re most likely incorporated in some way in which their tax liability is the personal tax liability of the owners (like and LLC or an S Corp).

We have RINO’s losing primaries and won’t call the Conservative winner but they would have no problems congratulating a dimoKKKRAT winner.

You know what’s funny is that Reason magazine employs tons of Republican haters, and libertarians-in-name-only. Many at Reason were writing for Obama to win back in 2008.

This is big in my view. Koch Industries are one of the worlds most secretive business enterprises ever. The Koch brothers don’t even like for light to get out of their properties.

They have only seldom gone public with anything and you mostly won’t find anything they own listed in the public domain. Yes, they are incorporated in shell upon shell to protect their personal assets but these are mostly privately owned companies.

My money is on Koch Industries. I hope this explodes before the election. These may be rich private citizens but they are private citizens. If obastard can smear them it is confirmed that none of us are safe from blackmail by obastard and crew.

Yes, they are incorporated somewhere but whether they are an S corp or a C corp is not public information. It is not even a state level designation and is an issue between the corporate officers and the IRS.

And LLCs can now choose to pay taxes like an S Corp if they wish to avoid double taxation.

For the Obama administration to divulge that Koch Ind is an S corp would require looking in the IRS tax rolls.
