Shep Smith on FNN just announced a judge in Riverside California has said banning gays in the military is unconstitutional, rendering DADT moot.

Judger needs to re-read the Constitution.

The Legislative Branch regulates the military, not the Judicial.
Hence the UCMJ.

If the ban is “unconstitutional”, then why did it take all of this time for them to “realize” it?

Has our Constitution changed since it was originally written?

Great, we don’t need no stinking Congress to decide our laws, there is a judge in Riverside, CA, who knows it all. One less thing to worry about.

Amazing how it's never hard to defeat the ‘standing’ argument on something like this, yet to compel an elected official who must meet particular terms to assume the office which they are elected to, no one appears to have the standing to demand such documents.

A shame that Obama feels that the only thing that needs to be vigorously defended is his own public documents.

Whenever I hear about one of these "Federal Judge throws out -insert common sense law here- because it is unconstitutional" stories, I think of some nut who just got his hands on some cheap booze spouting nonsense into an open microphone.

I can almost hear thousands of service men and women now saying “I won’t re-up, retire early”, and hear Military Morale sink to a new low-I don’t have much faith in it, but let’s hope the Obama Administration decides to appeal this ruling.

If one think has become patently clear over the last year and half: WE have to get controll, and reign in the Courts-They are out of controll!
