I hope the new congress will impeach the original judge. Obviously she is out of the mainstream, (I won’t hold my breath).

They didn't have a choice, believe me. If they did assert that a single federal judge could act in such a manner there was nothing to stop a single federal judge from stopping Obamacare nationwide.

At least that was my thought as to why rabid pro homosexual leftists would oppose this at all.

It’s not a ban. The military is simply telling gays to keep it to themselves.

Pun, most definitely, intended.

Where does the judicial branch of our government get the balls to tell the military that they have any say whatsoever in the military's recruiting process?

9th U.S. Circuit Court did something right...

They are just trying to push this issue off until after the election. they know that most Americans don't agree with the decisio0n to allow gays into the military and don't want Democrats to pay the price for it on Nov 2nd.

After Nov 2nd, they will jam this down our throats.

I missed something somewhere, but I thought if DADT was struck down, the original regulation would be followed.

We can put the Flaming 69th division in the front line to distract the enemy while the 1st Tomboy Battalion hits them from the rear.

I have heard that somewhere but I am looking for the actual proof...I know DADT was a policy but I am trying to determine the law that back it up.

I would think that the base document is the UMCJ. I do not think that the UCMJ specifies that homosexuality itself is a crime but it does deal with such issues as sodomy and conduct prejudicial to the service. The UCMJ is promulgated and authorized by Congress. Congress is the sole arbitrator of these issues under the constitution despite contrary court rulings from judges gone wild.

Elements.

There was a one minute spot on Armed Forces Radio today, that warned gay soldiers not to celebrate to early because it was still against numerous articles of the UCMJ, and it would be enforced

Finally some sanity, now we need to reign in the courts once Conservatives gain power.

In fact in Iowa, they are running a campaign to outster some judicially activist supreme court judges.

Hang in there, Joe. Let’s get thru the election and see if we win.

I agree with you, though, that the Marxist judge should be impeached, removed and hanged.

Thanks for the post.

I enlisted in the army in 1966 and served for a number of years. Served on a few administrative discharge boards. Most homosexual activity seemed to wind up as separations under other than honorable conditions rather than courts martial But all that was before DADT.
