Murkowski Judicial Appointee Orders Private Documents on Joe Miller to Be Released

An Alaskan judge who was appointed by Senator Lisa Murkowski’s father ruled today that personal information from conservative Joe Miller’s past must be released to the public.

The Anchorage Daily News reported:

A judge ruled today that the Fairbanks North Star Borough must release personnel records of Senate candidate Joe Miller.

In an unusual Saturday hearing, retired Superior Court Judge Winston Burbank ruled that the public’s right to know about candidates outweighed Miller’s right to privacy.

“I hold that although Mr. Miller has a legitimate expectation of privacy in those documents, Mr. Miller’s right to privacy is indeed outweighed by the public’s significant interest in the background of a public figure who is running for the U.S. Senate,” the judge said. A U.S. senator, he noted, is among the highest elected offices in the nation.

Burbank ordered that nothing actually will be released until Tuesday afternoon, however, to allow for the ruling to be appealed to the Alaska Supreme Court.

The judge said a handful of documents being sought would not be released, and some would be redacted.

The case was brought by a group of Alaska news media organizations, which have been trying since summer to see borough documents concerning Miller’s employment as a part-time borough attorney…

…The hearing drew about three dozen people to the otherwise empty state courthouse in Downtown Fairbanks. Current borough Mayor Luke Hopkins watched from the gallery. A legislative aide to Sen. Lisa Murkowski sat in the crowd, along with a News-Miner editor and a man who was shooshed for shouting that the judge was an old appointee of Gov. Frank Murkowski.

Judge Winston Burbank was picked for a District Court judgeship by Governor Frank Murkowski in 2003. Governor Murkowski’s daughter, Senator Lisa Murkowski (R-AL), was defeated by conservative Joe Miller in the Republican primary and is running against him as a write-in candidate in the general election.

Retired Superior Court Judge Winston Burbank (on right) opened the state courthouse on Saturday to rule in favor of the Murkowski campaign and far left Alaska media outlets.

I would be more impressed by openness and a willingness to bare his past, than by fighting this type of thing in the courts.

Why don’t we know Hillary’s grades, or see Obama’s birth cert, or etc, etc, etc.

If someone wants to be rule over us, then we have a right to look into their privates lives, and how they did in 1st grade, or who gives them $$.

Eska, you are so funny. I cannot imagine any Alaskan starving. Alaska has so much bounty. When we come home it’s salmon berries, blueberries with sugar and canned milk. OH YUM

Ya, I live pretty cheap out here. I could never face the hordes & high cost of living that one faces in an urban area. When I first came to Ak from Pennsylvania 20 years back, my family immediately realized a tax savings of about 15 gran in state taxes; unreal. Those guys down there are the enslaved ones and they happily accept the taxes, It's the conditioning I do believe.

All the rain this past summer, all kinds of blueberries up this way. Caribou came through, got a couple. No moose though, hot moose season and they only moved after dark; only 2-3 shot in our community; year before over 25 killed; so we eat bou. I put in trot lines for burbot, got some nice ones up to about 40 inches. Kinda salmoned out though.

We've only seen a couple days down to zero, kinda warm so far; but I know it will be minus 65 come January.

My aunt and uncle lived in Palmer and would allow the moose to feed with their cattle. Come moose season, they’d have their alloted meat in the freezer the first week. I don’t know what a burbot is. Sounds like you live near a river or deep creek. We had a creek run right along side of our house, when I was a child. My sis and I would fish from the back porch. We were on stilts.
