EDITORIAL: Justice shouldn't be political--Sandra Day O'Connor crosses the line

Former Supreme Court Justice Sandra Day O'Connor has violated the Code of Conduct for United States judges. She should resign from her position as a roving judge on "senior status." If she doesn't resign, Chief Justice John G. Roberts Jr. - at whose sole discretion she serves as a "pinch hitter" on lower federal courts - should no longer designate her for such duties.

In a controversial case Tuesday before a panel of the 9th U.S. Circuit Court of Appeals, Mrs. O'Connor provided the deciding vote in a 2-1 decision to throw out Arizona's requirement that new voter registrants provide proof of citizenship. This was not just another lousy decision in Justice O'Connor's long record of uneven jurisprudence. The deeper ethical problem is that she is active in political causes while continuing to serve as a judge.

This week, the retired justice was exposed for having recorded political robo-calls pushing a constitutional amendment in Nevada for state judges to be appointed by governors rather than elected by citizens. She claims she never gave permission for her recording to be used for robo-calls, but she recorded not just a voice message but also a video for a political group dedicated solely to passing this amendment - a group she leads as "honorary chairwoman."

Chief Justice Roberts should put an end to this promptly.

I'm not sure the Chief Justice should get directly involved. Maybe they could have Ginni Thomas call Sandra Day O'Connor on the phone and ask her to apologize for screwing up.

He could stop delegating her to the lower courts and lean on her, but Congress would have to impeach her to truly put a stop to it.

Maybe we should ask S D O'C why we should continue being citizens. I am wondering what benefits there actually are anymore for citizens over illegals. My husband became a citizen after living here for the 3 required years. He DID NOT VOTE before he was granted citizenship.

Good for him! I personally have known two people for many years that have green cards and no desire to become citizens, I don’t understand why.

Chief Judge KOZINSKI dissented in the opinion which can be read beginning at page 17684 of the opinion.

His final paragraph is as follows:

The majority distorts two major areas of law before it even reaches the merits. It creates an unprecedented exception to our law of the circuit rule, trampling underfoot a newly minted en banc opinion. The majority also makes a mess of the law of the case analysis by taking issue with a prior panel’s reasoning, not its conclusion. And, as to the merits, the panel comes nowhere close to proving that Gonzalez I’s interpretation of the National Voter Registration Act was wrong, much less clearly wrong. Few panels are able to upset quite so many apple carts all at once. Count me out.

Thank God this scumbag O’Connor left the Supreme Court, but it’s disgusting that she still runs around soiling herself and every court she sits on.
