The Minnesota governor's race is so close it has come to this: another recount appears almost certain. With 99 percent of precincts reporting, DFLer Mark Dayton leads Republican Tom Emmer by less than one half of 1 percent -- 43.67% to 43.24%. For any race where the margin is less than one half of 1 percent, there is an automatic recount, as happened two years ago in Minnesota's U.S. Senate race. "It looks like it's recount part II: And this time it's personal," said state Republican Party Chair Tony Sutton.

Emmer can chalk this one up to making a stupid statement (about the incomes of waitresses) and didn't have (a) the commonsense or (more importantly) (b) a professional enough staff to handle it with a quick mea culpa and "let's talk about taxes"; instead, he spent 2 weeks trying to make up for it and got continually hammered in the press. Too bad; Emmer would have made a good governor.
well if the gop will take control of both houses in the legislature then it is time to put in a photo ID for voting, I’d have absolutely NO objection to providing ID’s free for those who come with the proper documentation to their county licensing place, they can even bring a current bill or whatever to prove residency in the county they are applying in, then to vote one must be able to produce said ID at the poles, they can just make it word for word with those states that already have this law and have successfully defended it. (well I can dream can’t i?)
Did you elect a new Secretary of State in MN? I hope the criminal fraud artist that ran the Franken-Coleman recount will be gone soon!
I don't even have a law degree, but I can tell you that the Coleman legal team fumbled that badly by never getting it into the federal court system when the constitutional "equal protection" principle of Bush v. Gore would have pertained as a result of different methods of recount being used in different jurisdictions within the state.

Going to the federal system would not have worked for Norm. Where he lost was during the recount, the state Supreme Court improperly modified election law and said that each party could review the unopened absentee ballots, and if they agreed that a ballot should be opened and counted, go ahead and open it. Otherwise, the ballot would be submitted for review. Well, the DFL had done their homework and knew which counties were theirs, and which counties were Colemans (and blame that on crappy voter i.d. by the Coleman campaign). So, when the Franken people were in their counties, they were more than happy to agree to open up certain ballots. But in the Coleman counties, they resisted. Franken wins.
Coleman's people should have thumbed their nose at the Supreme Court and refused to agree to open any ballots. Coleman was ahead before this occurred, but ended up behind and never recovered. Blame the loss on crappy lawyering, not Franken "stealing" it.

Your points about the tip credit fiasco are well made. But I’ll go one further.
I believe that Emmer lost this race back in the summer.
Back then, the Alliance for a Better Minnesota bastards were running all kinds of negative and false ads about Emmer. Emmer’s campaign as well as the GOP never responded. Not once.
I believe that they succeeded in framing Tom Emmer in such a negative way that it hurt him at the polls.
I have worked in enough races over the years to know that you fight fire with fire.
And we didn’t.
And that’s why, pending any serious voter shenanigans that would throw this race into doubt, we will soon have Governor Mark Dayton.
Thank God Dayton will have a GOP state senate and state House to hold him back from running this state right into the f***ing ground!

Republicans have hired Michael Toner, a Washington, D.C., former chairman of the Federal Elections Commission. Before that, he was chief counsel to the Republican National Committee in 2001 and general counsel to the Bush-Cheney presidential campaign. He also volunteered to help Pawlenty start his Freedom First Political Action Committee, which Pawlenty set up as he explores a run for president.
Tony Trimble, the state party's general counsel, "is helping take the proper steps to ensure the ballots are secured and that we are going to be very, very aggressive in making sure that procedures are followed and it's not just happy talk from bureaucrats at the State Office Building."
Asked directly if he was charging voter fraud, Sutton replied, "I don't know if I am suggesting fraud or incompetence. We don't know yet, and that's what we are going to be pursing very vigorously."
Indeed so. This news makes me want to punch Tom Horner, though.
And the GOP legislature is a God-send. I was very worried about "gay marriage" getting passed, as well as re-districting. Just hope we have good leadership - I have no clue who will be the Speaker and Senate Majority Leader.
That’s a good step. Trimble’s office was the focus of my criticism. Repeated missteps over the years in other situations. Good example of why the state GOP is in such a sorry state - “establishment” cronyism at the top recycling the same losers. It’s a miracle we have Bachmann and Kline, and one should not forget that neither one of them was the choice of the establishment (still shudder about the support for Linda Runbeck in Kline’s seat).
Once eyeball review of any raw ballots was permitted (in the optical scan system), it would seem to me that the equal protection clause of the Constitution could be invoked pursuant to Bush v. Gore and a complaint made in federal court.
Hard to believe there would be no changes in the state law since then making optical scanning the only procedure to be used in a recount if the whole state voted that way originally. Once you get into visual inspection of the raw ballots, all hell can break loose, as proven in Florida in 2000.
