If two must recluse themselves, do they still need four votes or just three? Is it a majority of the justices qualified or the entire court?No matter how many recusals there are, four votes are needed to grant cert. If cert. is granted, a majority of the sitting judges is all that is needed for a decision (e.g., if there are 2 recusals, 4 justices are a majority).
