He's smart to try and prevent certification. If the election is certified, it becomes virtually impossible to undo. And of course, it becomes fait accomplis once she's sworn in, and out of the reach of the judiciary.

As a practical matter, I have great difficulty believing that a write-in candidate (even an incumbent) can win without some shenanigans. The question becomes, how do you prove it. Miller is going to have to reach a very high-threshold before any federal court intercedes.

Actually, between the fraud, union shenanigans, 300 verifiable voter complaints, the printing of illegal ballots a la Democrat illegality, misspellings, I do think Miller won, yes.

Probably not. Generally, certification is the event that signals all the counting and recounting is over, and that the state has declared an "official" winner. It's the last step before taking the oath and assuming office.

At this point, probably wants the Alaska law followed instead of trying to surmise voter intent from misspelled ballots.

I would assume that it'd be harder to challenge ballots once they've been certified. That's one of the reasons that they didn't want the Florida results certified in 2000 -- it would've meant suing to overturn the election results. (It still was but they weren't "results" yet ... yada yada yada ... forget I brought that up ... not responding to it...)

The military votes have been counted. There are no more out there.

This also isn’t about misspellings. She led by more than 2,000 votes that were spelled correctly. An additional 8,500 or so were challenged but counted for her.

Thanks, he's going to need cash and lots of it if he's going to be the one to finally expose these cheaters. There's a lot at stake here, the fraud will only get worse in 2012 if someone doesn't expose it before the election is over. Doesn't make much of a wave after.

“The Joe Miller for Senate campaign has released new affidavits swearing that Lisa Murkowski’s write-in campaign is benefiting from voter fraud. A notarized affidavit sworn on November 1 by a voter at Sand Lake Elementary School states when voting began, “there was already a stack of ballots in the box which in my opinion numbered in the hundreds.” The voter adds the ballots “were very neatly stacked and approximately 4 to 5 inches thick.” The affidavit adds this occurred at 7:00 a.m., and the voter was the tenth voter at that location.

This Author’s Previous Story Confirmed

A second affidavit, filed by election observer Elva G. Bettine, states write-in ballots from the Cordova and Angoon precincts seemed to have been filled in by one person. Bettine swore, “It appeared to me that the name ‘Lisa Murkowski’ that was written on many [of] these ballots was written by the same person.” This allegation lends credence to a previous allegations of “villages using one person to vote or fill in the write-in for several hundred people” this author reported exclusively on FloydReports.com. As previously reported, some Native villages supported “write-in” over Joe Miller by margins of 120-0.”

I believe his new argument, which has some merit, is that since all of Murkowski’s votes were hand-counted, allowing them to count otherwise spoiled ballots (Diebold is said to have trouble sometimes counting ballots correctly), that all the remaining ballots should be checked to see if there are more votes for him found by humans.

He also believes there were more votes than voters in some precincts, and I think he wants all the votes from those precincts thrown out since it would be “obvious” that some were invalid votes.

You are so right. And if I could add, it's not just the Alaska system that is under the microscope here, really this will have nationwide ramifications.

Voting processes MUST be repealed to 2000 levels. We must make that one of the priorites in this next 2 years. Of course this is just imho, but really, if we don't get a handle on this now 2012 is a foregone conclusion.

Well, he’s within his legal rights to do so. I have no complaint with anyone using the legal processes legitimately available to them. However, if the reporting to date on numbers is correct, I don’t think his chances of ultimate success are good.

“During a blogger conference call on Thursday, Alaska GOP Senate candidate Joe Miller accused Alaska’s lieutenant governor, Craig Campbell, of bias.

Miller, of course, is in the middle of a battle involving the counting of write-in votes for his opponent, Republican Sen. Lisa Murkowski.

During the call, Miller said:

“There are a number of fights that are going to have to be undertaken, in part, due to the fact that the division of elections [is] headed up by the lieutenant governor.

“The lieutenant governor is effectively the same [as] what you might see in other states as the secretary of state. His statements are policy. He was appointed by Murkowski . . . has connections to the Murkowski family. In fact, when he, last summer, spoke at the time Sean Parnell was sworn in as governor, spent five or 10 minutes praising the Murkowski family. It was really kind of a curious thing given the lack of popularity at the time of Frank Murkowski.

“But in any event, it appears that his bias is playing out in the decisions that he’s making, especially those that are directly contrary to the law.
One of the decisions Miller complained about on the call involves the decision not to count the votes of people who wrote in the name “Joe Miller.” Miller says Alaska statute requires those votes to be counted.”

SITKA, ALASKA (2010-11-18) The results of the Sitka Tribe of Alaska’s Tribal Council elections are scheduled to be certified on Saturday. The results were originally scheduled for certification during Wednesday’s (11-17-10) regular meeting of the Tribal Council, but a recount required that the certification be postponed.

The recount happened Monday after tribal council member Tom Gamble came within three votes of beating incumbent Woody Widmark for the tribal chairman’s position.

The way it is apparently working is that the election officials are counting votes. For example, election counter, “Here’s a vote for Miller.” Election Judge, “Who is that idiot.” Election counter, “Here’s another vote for Miller.” Election Judge, “That SOB voted twice, throw both votes out.”

Stuff like sworn depositions and affidavits from election judges that ballot boxes were pre-stuffed prior to opening time on election day; stuff like voters exceeding registered populations in many areas.

For me, it’s speculation based primarily on instinct.

Miller strikes me as a man that wouldn’t waste his time in a fight unless there was a reason to believe he would win. It is entirely possible that he is working with information that is not available to us.

What a great day it would be if Miller pulls this off, especially if it’s by only a couple hundred votes. Even sweeter if he catches someone dirty in the process.
