Like any responsible pregnant woman, Chen Lei (not her real name) wants the best for her unborn child. She and her husband live in Shanghai; both work for a foreign IT company, and they have more choices than their parents' generation could even dream of.
So Chen, 30, is one of an increasing number of mainland Chinese women who are taking advantage of a loophole in American law to travel to the United States to give birth.
"Most Chinese women who go to the U.S. to give birth do so for their child's future, for the education, and for the work possibilities. And that's true for me, too," says Chen, who is cautious and does not to want to reveal her identity.
"We just want to give him more choices in life," Chen adds.
Her unborn child a boy will have more choices than most Chinese babies. In a few weeks' time, she will board a plane for Los Angeles, where she plans to give birth in an American hospital.
According to the 14th Amendment to the U.S. Constitution, anyone born on U.S. soil has the right to U.S. citizenship.
Originally ratified in 1868 to guarantee citizenship rights to freed black slaves, the amendment has been controversial more recently in the American public political debate because of poor, illegal immigrants from Mexico and Central America coming to the U.S. and giving birth. An estimated 340,000 of the 4.3 million babies born in the United States in 2008 were the children of undocumented immigrants, according to an analysis of Census Bureau data by the Pew Hispanic Center.
There is another group of people arriving in the United States to have children. But this group comes legally, often in first-class airline seats: mainland China's upper class.
A whole host of middlemen have sprung up in China to facilitate the booming trade, foremost of whom is Robert Zhou, a Taiwanese businessman.
For roughly $15,000, his company can arrange the hospital in Los Angeles, the doctor, the house and car rental, and any number of other extras for wealthy Chinese parents-to-be.
"What I'm trying to do is to help Chinese mothers to realize their American dream, at a fair and reasonable price. We're not encouraging pregnant women to go and get a U.S. visa. We say that if you already have a U.S. visa, and you're pregnant, you can take the opportunity to give birth in the U.S. So yes, it is a gray area in U.S. law," Zhou says.
Anti-immigration activists in the U.S. say the 14th Amendment was never meant to be applied this way. The Department of Homeland Security and the State Department have no specific regulations regarding pregnant foreign visitors like Chen.
Zhou insists his clients obtain U.S. visas themselves before they even approach him. He says they are paying for everything themselves, and not being a burden on U.S. taxpayers.
Even though there are many opportunities in China, Zhou says, there's no doubt access to a free U.S. public school education, and reduced college costs that come with being an American citizen, are worth the investment. Children who go back to China with their parents can later return to live with relatives already in America, establishing residency and taking advantage of state-supported schools.
"For lots of Chinese people now, $15,000 is very affordable. And it's still at least four times more expensive for a foreign student to study at an American university than it is for an American student. With a U.S. passport, there are no barriers for study or for work," Zhou says.
America's Allure Different For Parents
Zhou has helped as many as 600 mothers give birth in the U.S. in the past five years. Some are doing so to skirt China's strict one-child law, which doesn't apply if a child is born to Chinese parents outside China.
When they've gotten a taste of American life, Zhou says some people do want to emigrate. But the majority of parents, like Chen, don't want to move to America themselves at all.
"We work in IT, and for people like us, it's better to stay here in China. We have a great quality of life here, so there's no reason for us to move," she says.
There is one other advantage of giving birth in the U.S., Chen says.
Last Christmas, she went to a conference in Las Vegas and bought eight pairs of designer shoes, for about $200 each, half the price they cost in China. She is going to Vegas again, she says, to do some serious shopping, before she gives birth in the new year.

We need to fix this loophole. In addition, we need to deport or imprison ALL illegal aliens, seal/secure the border with a fence and wall, and have a lethal response to anyone trying to re-enter illegally.
oh I get it, it’s only a problem because these women are actually paying for the births, rather than sticking the American tax payer with the bill.
They're not taking sides, but it's a good story. Count your blessings.
It’s not just China, but they’re coming from all over the world. They also manage to have access to medicare and medicaid as well. So American taxpayers are subsidizing their invasion. How they manage this I don’t know, but my niece whom works at a hospital sees this all the time.
This is also a way around the one-child policy.
A Chinese woman can give birth to a second child in America, bring it back to China and keep it — have TWO children! The Chinese government doesn’t consider the second child “Chinese” and therefore allows it.
That is the first time I was exposed to that issue. Interesting. A little freedom is intoxicating.

Yes, they don't want to be here. China is MORE capitalistic than the U.S.! THAT is not China's fault so bashing China won't do you any good.Thank the Demoncrappers and RINO’s for that FACT. At some point, we may want to give birth in China and STAY THERE where there is OPPORTUNITY. Don't get too upset with China ... at some point soon if things don't change, they won't be here to give birth and leave. In many villages were people are not poor and SELF supporting, they WINK at the “one child policy”. It is arbitrarily enforced.

We spent a few months in China back in the late 90’s when my husband was there on a work assignment. Several of his Chinese business acquaintances had several children. I inquired how that was possible, and they said if you were willing to pay a fine, you could have multiple children. A true case of the “have and have nots.” :)
Ironically it is the Chinese that you should want to STAY since they want to WORK and have a BETTER LIFE. Even they don't want to stay.

Yes, you see the Chinese are MORE CAPITISTIC than we are. All they want to do is avoid the one child policy where it is still being enforced. As I mentioned to another poster, it is arbitrarily enforced. You see, in China as people become MORE PROSPEROUS, their government officials WINK at the one child policy.
And perhaps it is good that comparatively wealthy, intelligent people want their children to become US citizens.
But what is to stop the population density of the US from approaching that of China?
And who could successfully lead a movement to change the citizenship clause in the 14th Amendment?
It is possible that the Chinese government "planned" the one child policy to allow this. And, by the way, some Chineese "citizens" (many X-pat) have had a reputation for being "extremenly good businessmen" for centuries.
However, don't kid yourself, the ChiComs have not changed stripes. Communist and Communism are always evil. They are by definition not for freedom, although some understand it.

No country in Northern Europe offers birthright citizenship.
No country in Western Europe offers it. Nor does any country in Southern or even Eastern Europe offer it. Nor Japan, Korea, Australia, New Zealand.

Australia’s birthright citizenship requirements are much more stringent than those of H.R. 1868 and took effect in 2007.

United Kingdom repealed in 1983

House Republicans plan to end birthright citizenship

Ending citizenship rights granted to children of illegal immigrants born in the United States of America will be one of the first objectives of the Republican-led House of Representatives, according to a published report.
The 14th Amendment specifies that anyone born in the US is automatically granted citizenship at the time of their birth, regardless of whether their parents are citizens.
The first clause of that amendment, which was ratified in 1868, states that “all persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.”
Rep. Steve King (R-IA), who has represented Iowa’s 5th congressional district since 2003, is expected to push a bill that would deny birthright citizenship to children of illegal immigrants, according to McClatchy Newspapers.
King, who has been appointed as the next chairman of the House Subcommittee on Immigration, claims the amendment was not meant to confer citizenship on the children of undocumented immigrants because at the time of its ratification there was no immigration law.
“Because the 14th Amendment has been misconstrued, current law inappropriately gives American citizenship to the children of illegal aliens solely because their parents were able to cross our borders illegally and give birth here,” King said in October.
“As a result of this perverse incentive, an entire ‘anchor baby’ industry has developed which exploits a legal loophole caused by a misinterpretation of the Constitution,” he continued. “Many of these illegal aliens are giving birth to children in the United States so that they can have uninhibited access to taxpayer funded benefits and to citizenship for as many family members as possible.”
According to King and others who wish to end birthright citizenship, pregnant foreign women purposefully come to the US to give birth so that their child will be a legal US citizen. These so-called “anchor babies” then make it easier for the parents and other family members to remain in the US.
Two Republican representatives from California, Tom McClintock and Dan Lungren, have also voiced support for a bill that would deny birthright citizenship to children of illegal immigrants.
“If illegal immigration is to be rewarded with birthright citizenship, public benefits and amnesty, it becomes impossible to maintain our immigration laws and the process of assimilation that they assure,” McClintock said.
According to an investigation by ThinkProgress in October, 130 Republicans in Congress have supported ending birthright citizenship.
In a spin on the “anchor babies” issue, Rep. Louie Gohmert (R-TX) claimed in June that ending birthright citizenship was a national security issue because terrorists were reportedly sending pregnant women to the United States to raise “terror babies.”
Obama will veto this if it passes which I have my doubts ... .
It is my understanding that the “interpretation” that allows anchor babies to be citizens, is such, that by “re-interpretation” it could be eliminated without legislation. It is unclear as to “intent” of the legislation.
