Just this past Friday, we warned you that a Federal Communications Commission (FCC) December Internet power grab was probably coming.
Well, we now know that it is – and it may be even worse than we thought.
Details have been sketchy, and successive reports often contradictory, but what follows is what seems to be looming over us in December. (We will know for sure on Wednesday, November 24 – if the FCC maintains its current December 15 meeting date.)
FCC Chairman Julius Genachowski appears to be preparing to dramatically increase the FCC’s regulatory role over the Internet (in TWO ways; more on that later).
He is doing so without the necessary Congressional authority – which he himself acknowledges he doesn’t have. And he is doing so by torturing and twisting the regulatory language he is drafting – so as to keep this extraordinary dictatorial seizure within the current Title I confines.

The Republicans in congress had better do something about it in January or they'll never win another national Presidential election and they'll lose the House in 2012.

The weird thing here is WHAT is the big “problem” that supposedly exists that has to be rectified by government regulation of our flow of information on the Web? I have posted THOUSANDS of posts without any hindrance for years. Anybody else have such trouble? I think not yet here the FCC steps in to supposedly fix a problem that DOES NOT EXIST.

You knew this was coming. They can not stand anything that they can’t control. They hate anything that empowers the individual over the collectivity. They have their vicious fangs out and want to know who visits what site, who posts what, who buys what.
Their goals are statist goals: tax the hell out of it until it dies, then take over; monitor all communications and punish those who violate their rules; burden it with oppressive rules and regulations that will deaden growth.
After Jan 3rd there is going to be a new Sheriff in town and things are going to be diffrent.

I think that people do not see all the pieces that are in motion.
The FCC maneuvers for control of the internet -- heavy government intrusion in communications. For no reason at all.
The TSA manhandles men, women and children at airports -- heavy government intrusion as people seek to move freely about their country. For no reason at all.
USDA is cracking down on home gardening -- heavy government intrusion in private food production. For no reason at all.
It's coming people. The government is a boa constrictor and it is thoroughly wrapped around us and now the coils are tightening.
So true. Now all we hear is if we actually do something about the tyranny, we are giving Obama what he wants.
I say either way, Obama gets what he wants. Question is, do we?

Rule making at federal agencies is governed by the Administrative Procedure Act. If the FCC intended to adopt a new rule at its December meeting, it would have had to issue a Notice of Proposed Rulemaking, have gone through the public comment period, and so on. Administrative rules which are adopted without following the governing statutes are void.
