It is time to rein in the power of government agencies.

In the past several weeks we have heard rumors that the president plans to use the many government agencies he is the head of to force through regulations that he cannot get through constitutional and congressional channels.

Why has Congress allowed this? My guess is partially through laziness and political cowardice as Congress would create a government agency and give it power to create rules affecting everyone without having to go through the actual trouble of doing it themselves and so they could avoid blame for the problems created by those agencies. Partially it was through stupidity and naivete as they thought that the agencies would only do good and necessary things and that their powers wouldn't be abused.

But even worse were the people who KNEW that putting the power to literally make laws (and call them "rules") into the hands of ONE PERSON would eventually lead to someone who has absolutely no restraint on his own desires or political ideology who would use the power they were given to bypass the Constitution, the Congress, and the will of the people, yet did it anyway!

Many, many liberals have wished out loud that Obama could be a dictator so that he "could get things done". Well, for all practical purposes, they have gotten their wish because Obama is now instituting plans to do the will of George Soros through Executive order and regulations.

In the past he has shown that he has absolutely no concern for the safety, security, or economic health of the United States or its citizens by instituting an outright ban on drilling in the Gulf of Mexico and off either the east or west coast. Recently it was revealed that he is being encouraged to use the power of the FCC to impose "net neutrality", as if the FCC has any authority to do so, to use the EPA to FORCE a system of "carbon trading" that Congress would not pass, and now to appoint an anti-gun zealot to the BATFE to impose regulations and rules that are not required by law. And I am absolutely sure that I don't know even 0ne percent of what he has planned.

What can be done? The short term solution is simple. Have one senator and one congressman insert an amendment into any (all?) legislation that states something like the following: "No government agency, organization, or entity created by Congress shall have the power to create rules with the power of law without full consent of both houses of Congress." Additionally, "Presidential Executive Orders shall be restricted to directives pertaining to the internal workings of the agencies under his control and shall not be used to create, change, alter, or abolish any law."

Perhaps I am being simplistic as I am just a simple engineer who sees things in black and white, but the lawyers out there can fix the wording. It is time for a change and it is time to reign in the power of the government and this is a good starting poing.

But Obama and the DEMs LOVE the Soviet Union model where THE PARTY controls everything. So, the ADM bypass of Congress is perfect for Democrats.

Unfortunately, the power of law changes have to go through the Kenyan. Money has to be appropriated for any law they make, but money bills originate in the House so there is some power in that that can be exercised to limit the Kenyan’s reach. At least, I am praying that they will wield that power in the House.

Amendment XXIX

Article I: Congress shall make no law delegating legislative or judicial powers to officers of the United States. For the purpose of this article, “legislative power” shall be construed to mean the making of any rule violation of which renders a citizen of any state or the United States to imprisonment, fine, or other punishment. “Judicial power” shall be construed to mean, the holding of any evidentiary hearing not presided over by an Article III court or the issuance of findings which result in imprisonment, fine, or punishment of a citizen of any state or the United States.

Article II: The original jurisdiction of the Supreme Court shall extend to suits by any citizen claiming that he has been subjected to delegated legislative or judicial power.

Article III: The original jurisdiction of the Supreme Court shall extend to cases in which the executive authority of 1/3 of the states request a finding regarding the constitutionality of any law passed by Congress.

Article IV: In the case that the executive authority of 2/3 of the states transmit in writing their opinion that a law is unconstitutional to the Speaker of the House and the President of the Senate, such law shall be without force and void.

This has a simple solution.

Allow citizens to file suit against any govt agency whose regulation is pernicious and a threat to a person or business. Said agency has to pay the court fee for both sides; the agency has to demonstrate that its regulation is not pernicious or economically harmful; all damages come from the agency’s budget; that agency loses that amount from the next year’s budget. Loser pays.

The problem with that is the government is in charge of the courts who would rule that ANY rule is likely to be detrimental to some and they would throw your lawsuit out. Then you would owe millions to the government for their costs.

Your solution is much too complicated.

Stop delegation of powers by legislation by amending the constitution, by convention if need be.

Not only rein in but eliminate 50 percent of washington, sell it off to pay our debts, Irs, dept of education, gone, no income estate, capital gains taxes, sell off national parks if selling off washington won’t get us out of debt..starve the beast , defund Washington and make state and local entities responsible..

But would it retroactively remove all the rules that have been imposed so far. I would add to Article 1.

“to officers, agents, agencies, departments, bureaus, commissions, or authority of the United States” (don’t leave them ANY wiggle room)

“All rules and regulations currently in place that meet the definition of “legislative power” shall be null and void upon ratification of this amendment. “

BTW, at this point, it would be much easier to simply pass a law removing legislative and judicial power with a law they were give the authority to create them with a simple law. We can amend the Constitution later.

That is why you put the wording in EVERY piece of legislation that goes across his desk. Especially the 13 bills that are required to be passed.
