What a bunch of garbage! An elderly Manhattan woman living on Social Security was slapped with a $100 ticket -- just for throwing away a newspaper in a city trash can. Delia Gluckin, 80, tossed the paper in a bin right outside her Inwood apartment building Saturday morning, only to be ambushed by an overzealous Department of Sanitation agent wielding a handheld computertized ticket book. "I was walking to take the subway downtown and dropped it in a trash can, and this lady in a blue uniform ran up to me," Gluckin told The Post.

Next time she should just throw it on the street. After all New York is already a garbage dump, one more piece won’t hurt.

How far do you have to be from your residence before you can throw something away and not have it considered personal?
This is one stupid cop using an ill defined ordinance to harrass an elderly woman.
This cop reminds me of all the ignorant TSA agents who love throwing their weight around in the name of following policy.

Recycle so its just another opportunity to ticket a person. She literally had to find the appropriate bin or take it home and put it out with the recycling. If you walk between subway cars,som type have locked doors,others don’t,you can be ticketed. Theres a sign says no walking between cars but it doesn’t say its illegal. It could be a safety suggestion. NYC has a million way to ticket a person for revenues.
Time to get the burden off the landlords.

So we have the terms “litter”, “garbage” and “refuse” being used here. What is the legal definition of each?
I just read the article. It’s actually pretty comical.
For starters, since I am not driving, if they INSIST on writing a ticket, I just give a false name and address, while looking really sheepish and intimidated.
Second, even if I did give my correct name, it is up to them to prove what I threw away was household trash.
I thought this HAD to be the onion when I first read it.

Apparently their function is to increase city revenue.
The only ticket my wife had ever gotten in her life was when she was in Chicago a few decades ago. A cop had put a “no right turn” a-frame on the sidewalk at a business area intersection that she (and a lot of people) used to turn right on their way home from work, shopping, etc.
It was late at night and the sign was in shadow. She turns and, around the corner is a cop that flags her down and gives her a ticket for the turn. And then he gets the next car, and the next.
It was like a fisherman casting a net.
NO! The Sanitation cop did the right thing and should be rewarded. She finally ticketed the correct party instead of landlords who have to pay fines for what their tenants do.
Change the item. Your dog poops on the sidewalk. You leave it there. Landlord gets fined for the poop. Is this correct? Same rule applies to granny. Since she lives in NYC, is a tenant, she knows the rules.
