The most common misconception about the Constitution is that the three branches of government it created were “co-equal.” This is nonsense.

A united Congress can impeach and remove from office any executive branch officer any judge. Congress has final control. The other two branches have no equivalent checks over Congress.

Congress abdicated this control because it’s easier. Pass all the tough questions to the Court and you can go home and campaign on the idea there was nothing you could do about it. Similarly they have passed massive amounts of authority to executive branch agencies rather than writing what should be laws.

Yes, as noted by a Framer or two, the power to make law alone makes Congress the most powerful branch. The abdication of their duties to courts and administrative agencies is horrible.

That is certainly MY view as well! The fact that congress has not chosen to exercise it’s prerogatives in this area is a matter for US to correct!

The post is total nonsense. First of all, we've been down this road. If all you want to do is pretend to open up a discussion, just so you can repost past rubbish, don't bother me with it. I'm not interested.

You didn't demonstrate anything except a lack of knowledge. It doesn't matter whether the SCOTUS has original or appellate jurisdiction. It doesn't affect the overall scope of power of the federal judiciary.
