U.S. sues man who ran zip lines in (the Columbia River) Gorge National Scenic Area (on his own land)

TACOMA — A Washington man who was briefly jailed last year for violating a state court order that he stop offering zip-line rides (snip) is now in trouble with the federal government.

The U.S. Attorneys Office sued Derek Hoyte this week in federal court in Tacoma, saying the U.S. Forest Service recently confirmed reports that Hoyte has reinstalled zip lines on the property and is constructing a suspension bridge without permission.

The Forest Service says Hoyte has built roads and cut trees on an 80-acre parcel he owns near Washougal in violation of a conservation easement the government obtained from the previous owners of the property. Prosecutors are seeking a restraining order and asking that Hoyte be forced to compensate the government for damage to the land and pay triple damages for any lumber he cut.

In the not too distant past there was always the idea you could fall back to the wilderness if you had too in times of extreme upheaval.

Now, if you even dared try it, you’d be shot on sight to protect any wild animals, or vegetation there from being bruised.

Actually, Alaska is sounding a lot better with each passing day. Somewhere about 500 miles from the nearest neighbor should be just about right.

If he was told of the easement when he bought the property, then he must comply with it. If the title search did not reveal the easement, then he can sue the title company.

I have a problem with some easements, but if there was an easement, he does have to comply.

Sounds like a clear case of trespassing to me.

I hope he sues them for everything he can. Easement violations are one thing, trespassing is criminal. Someone should be going to jail.

Years ago I would have agreed, but now I think lawyering up is BS. This is militia work and a public campaign. Time to push the tyrant (Federal Government off our land. Local Government (and state) should be backing him up and so should his neighbors because it is only a short time before they will be using their land wrongly.

Many years ago my grandfather had a government worker, a game warden pull down on him while he and some others were hunting deer out of season. They turn the tables on him, tied him to a tree with barbed wire and left him there in the woods for three days before calling his offices to tell them where they could find him. He left the service and moved out of the area. It has nothing to do with anything but I thought it made a good story.

If he purchased the land with the easement in place, then he is in the wrong. He might have an action against the seller and / or his attorney if the easement was not disclosed but that’s not likely.

AMEN! I just wish I could sell out and get out of Northern NV, But I cannot, I am just too old, however I have lot’s of staples stored, lot’s of medical Supplies, and lot’s of ammo and mil grade weapons. I also have the training and back ground to use all of the above courtesy of the USN. SO it is stand and fight for me!!!
