Judge to tour California's death chamber

San Francisco, CA (AP) -- A federal judge who halted lethal injections in California over concerns that it was cruel and unusual punishment plans to tour the state's new death chamber in February.

U.S. District Court Judge Jeremy Fogel on Wednesday told attorneys representing a death row inmate who filed a lawsuit and the state attorney general's office that he wants to hold a hearing at San Quentin State Prison sometime in February. Fogel is determining whether the state's new lethal injection procedure is constitutional.

Fogel halted executions in early 2006 and ordered prison officials to improve their lethal injection process. . . .

Born in San Francisco, California, Fogel received a B.A. from Stanford University in 1971 and a J.D. from Harvard Law School in 1974. He was in private practice in San Jose, CA from 1974 to 1978. He was a Lecturer, Human Development, California State University from 1977 to 1978. He was a Law Foundation, Inc., Santa Clara County, CA Bar Association from 1978 to 1981. He was a Directing attorney of Mental Health Advocacy Project from 1978 to 1981. He was an Executive director from 1980 to 1981. He was a judge on the Santa Clara County, CA Municipal Court from 1981 to 1986. He was a judge on the Santa Clara, CA Superior Court from 1986 to 1998.

Fogel is a federal judge on the United States District Court for the Northern District of California. Fogel was nominated by President Bill Clinton on September 8, 1997, to a seat vacated by Robert P. Aguilar. He was confirmed by the United States Senate on March 16, 1998, and received his commission on March 17, 1998.

So murdering someone isn’t cruel and unusual but killing them for the murder is? We need to seriously think about drastically changing our court system in this country.

As tempting as public executions are, I think that it needs to be done quietly and unceremoniously. 9mm to the back of the skull in a basement room with a drain. Body goes out with the trash or is turned over to science.

Cruel? Most of us will suffer a far more painful end than those executed by lethal injection. Unusual? Well, sort of, inasmuch as most governments are not so solicitous of those sentenced to death.

We still have several on CA's death row convicted during Carter years, over 30 years ago!

Five years is too long to be waiting for this judge to make up his mind.

Where's the "justice delayed, is justice denied" crowd?
