Supreme Court Justice Sonia Sotomayor has set herself apart from colleagues with her fervent statements protesting the majority's refusal to take some appeals, particularly involving prisoners.
Each month, the justices spurn hundreds of petitions from people who have lost in lower courts, and rarely does an individual justice go public with concern about the denial. In the seven times it has happened since the annual term opened in October, Justice Sotomayor has signed four of the opinions, more than any other justice. She was the lead author on three, again more than any other justice.
She forcefully dissented when the justices refused to hear the appeal of a (Sotomayor protests court's refusal of appeals) prisoner who claimed he was punished for not taking his HIV medication. He said prison officials subjected him to hard labor in 100-degree heat. Writing alone, she said the inmate had a persuasive claim of cruel and unusual punishment.
This emerging pattern of dissenting statements helps define a justice in her second term who is still like newest justice (Elena Kagan) fresh in the public eye.
The Wise Latina, like her buddy Obama, is in way way way over her head. She will become the buffoon of the court over time.
“Sotomayor is an activist, she doesn’t really read law, she makes it.”
She is dispensing some “Social Justice”
This is what happens when you have an Incompetent in Chief nominate an inept anarchist to the Court, with a Press Corps who are playing favorites.
I wonder if Pat Toomey is regretting his support of her nomination yet???
Sotomayor is a Latina Doofus.
He said she's adopting a much different approach. "There seems to be real feeling behind these opinions," he said. "They give the criminal defendant's perspective on these issues."
So, when will Mr. Souter be accusing HER of "lying" in order to get a supreme court appointment (like he did with Alito and Roberts)?
God forbid....if barry has the opportunity to make another supreme court nomination...those weasily RINO’s BETTER vote no. I mean it.
Do we need to come surround the U.S. Capitol again? Cause I’m ready. My patience with RINO votes is wearing thin. We’ll march against them sooner than against democrats.
Sotomayor is also stupid.
“There seems to be real feeling behind these opinions,” he said. “They give the criminal defendant’s perspective on these issues.”
We don’t need feelings, jackwagon. We need laws.
The wide Latina can weep all she wants, but she needs to apply the law of OUR land.
Sotomayor owes her appointment to a constitutionally unqualified President, but I applaud her public dissent to decisions on refusal to grant certiorari.
I for one would certainly have liked to read similar dissents from Scalia and Thomas on the court’s refusal to hear cases on Obama’s eligibility. Instead SCOTUS cloaks its refusal to act on urgent matters in inscrutable silence.
The Supreme Court cannot hear every single case presented to it. The correct decision some, if not most of the time, is to let stand the lower court’s decision. Sotomayor wants to be the sole decider of such things.
Even Moses had to appoint “lower” Judges to hear less important matters and make decisions. He was persuaded to do this by his father-in-law.
Her head looks bloated.
Oh, it's just the fat that makes it look that way.
The Wise Latina is attempting to pay back her patrons by bringing these cases for review.
Her votes and opinions are radical. If another liberal gets on that court Sotomayer will do immeasurable damage to this country. She’s a pure leftist idiot.
What are she and Kagan doing on the Court in the first place? It’s becoming obvious neither can rule on most of the cases heard.
They both need to step down.
