MANATEE, Fla. (AP) A group of unruly teenagers attacked a 27-year-old Marine and his wife who had asked them to be quiet during a Christmas night showing of "Little Fockers."
The attack happened as the couple left the theater near Bradenton Saturday night. Authorities say the fight attracted about 300 bystanders.
Federico Freire, home on leave from Afghanistan, says they left the theater shortly after the teens were asked to leave.
The couple was kicked and punched in the parking lot before a gun-brandishing witness told the crowd to step back just before deputies arrived.

I don’t know, I betting the Marine was just getting warmed up. Too bad he didn’t have a squad with him.
The problem is,
you can be arrested and lose your CCW for “brandishing” a gun.
The laws are pretty dumb in that you really have to shoot somebody if you show your carry weapon in order to avoid a “brandishing” charge.

As they exited the theatre just before 10 p.m., Kayln Freire was surrounded by about 15 girls who looked as if they were going to attack her, Federico Freire said.
A witness said he had a firearm in his vehicle and offered to escort the couple to safety. Federico Freire said he told his wife to go with the witness to get her out of harms way.
Seven males then surrounded Federico Freire and began to kick and punch him.

Another male juvenile also hit the same deputy in the arm and resisted arrest after he was asked to leave the area. At that point, there were about 300 people involved in the incident.

What a miserable night. They endure the pain of being attacked in the parking lot after having to endure the pain of watching “Little Fockers.”
At what point is a 27-year old man permitted to use military force hand to hand combat techniques against a 15-year old boy?
These kids were out for blood. Under such circumstances, could he still be charged with attacking children with possibly lethal response if he’d punched their heads and kicked their kidneys?
If the writer understands the meaning of 'brandishing' it provides a description of what the 'witness' did. I do not find it a 'funny way'.
They walked out of the movie after their night had been ruined inside the theater by the brats.

We were just so aggravated. We thought, Forget this, were out of here, Federico Freire said during an interview Monday.

All available deputies were asked to come out to the theater to help restore order to the area, the release said. The manager then shut down the theatre.
Im fine. My wifes face is all swollen up. Shes got cuts in the inside of her mouth. I was able to defend myself pretty good because of my training, but I was more worried about her, Freire said.
The situation is under investigation by the sheriffs office and the charges and names of the juveniles who were arrested have not been released. Their ages range from 15 to 17-years-old, deputies said.
McNeil was charged with resisting arrest without violence and was released from Manatee County jail Sunday on a $750 bond.

From the comments on the article, this is not an isolated situation. The kids make a nusiance of themselves repeatedly there.

She was charged with resisting arrest without violence and was released from Manatee County jail Sunday on a $750 bond. Reginald Gardner, 17, also hit the same deputy in the arm and resisted arrest after he was asked to leave the area. Gardner was stunned in the chest with a Taser by a deputy. Both Gardner and Dunbar were charged with battery on a law enforcement officer. The names of 15-year-old twin brothers who were charged with misdemeanor battery for striking the couple were not released. Details of misdemeanor arrests for juveniles are not public record under Florida law.

Not really. Fla Statute:
"If any person having or carrying any dirk, sword, sword cane, firearm, electric weapon or device, or other weapon shall, in the presence of one or more persons, exhibit the same in a rude, careless, angry, or threatening manner, not in necessary self-defense, the person so offending shall be guilty of a misdemeanor of the first degree".
Besides the picture of the “mom”, there was no indication as to the skin melanin content of the “yutes” involved.
However, the absence of this information in the article is a big indicator,
as well as “being loud in a theater”
as well as taking offense when asked to be quiet
as well as committing thuggery to those who asked them to be courteous —
all indicators of cultural tendencies that our society shouldn’t tolerate.
When the kids are attacking officers who show up on the scene, it makes you wonder what good a single gun would have done. How long before the rest of the gang would have started to return fire? The numbers make this an unwinnable situation.

I forget what state they were in, that could significantly affect how the law looks at self defense. Of course having a citizen in the croud with a pistol is a good sign.

So punching a civilian (a woman no less) in the face and knocking her out is "misdemeanor battery" (unless you are her spouse/partner) but punching a cop in the arm is a felony charge. Lovely situation they have there.
Glad to see that Fla has common sense “brandishing” laws that implicitly allow the display of a weapon to deter crime.
Some states are not so sensible.
