A federal judge on Tuesday dismissed a lawsuit challenging Alaska Sen. Lisa Murkowski's write-in election victory last month, clearing the way for Murkowski to be sworn in for a second term next week.
Lt. Gov. Mead Treadwell later announced that the director of the Alaska Division of Elections certified Murkowski as the winner, defeating fellow Republican Joe Miller by a vote of 101,091 to 90,839.
Murkowski was defeated in the Republican primary in August by Miller, a Tea Party-backed candidate. Murkowski then waged the write-in campaign in the general election in November to defeat Miller, who filed a lawsuit challenging the result.
U.S. District Judge Ralph Beistline had previously issued an injunction to block certification of the election results pending a resolution of Miller's lawsuit. In his ruling Tuesday, Beistline said "the injunction is lifted and the Division of Elections may certify the election results immediately."
In Alaska, state officials have scheduled a Thursday morning ceremony to sign the election certification, according to Sharon Leighow, spokeswoman for Gov. Sean Parnell. The certification will then be flown to Washington to be delivered to the Secretary of the Senate.

I stand corrected. But if the Supreme Court had not ordered the state to hand count every ballot in the state and not just a selected few, I guarantee that the outcome would have been different.
I agree. It was either the whole state or none. It was not just to count the counties Gore wanted counted.

Joe Miller ran one of the crapiest campaigns ever.
All he had to do is run one add and pound the airwaves with it:
“Lisa and the democrat are against repealing health care, I am for it. Lisa and the democrat are for cap and trade, I’m against it. Lisa and the democrat are for amnesty, I’m against it.”
I don’t know who these high paid idiot campaign consultants are, but they’re not doing the job. At least his weren’t.
Miller was smug and lazy. Murcow didn’t win it, Miller lost it.
The Federal Judge, Ralph Beistline, is a JWBush appointee from 2001. He completely agreed with the Alaska Supreme Court.
He dismissed Miller’s complaint “with prejudice”. This is rare; it means that Miller cannot file another case or appeal. (Beistline could have dismissed “with leave”, which would have allowed some options for Miller.) It means that the Judge found Miller’s complaint totally without merit, and in some issues “frivolous”.
It is a stinging rebuke to Miller’s arguments.

in Alaska, the election rules were set long ago....everyone has to follow them...supposedly
then you have this election and many "rules" were changed after the election process had begun....rulings were made that favored one candidate....rulings were made that had never been acceptable before....
maybe Miller ran a poor campaign....I don't know....but he got shafted by the establishment both Alaska and the pubs.....

It might be a matter of time, though.
really wouldn’t surprise me at all to see Murkowski formally change parties, unless the Dems want her to stay put so when she votes with them, they can claim “bipartisanship,” much as they do with Snowe and Collins.
Murkowski’s smile is ANYTHING but Alaska. It is Chicago, Los Angeles, etc..
Alaska and Alaskan’s got the BIG ONE, just like Nevadan’s.
There is NO difference between a Murkowski and a Reid. They have connections, NOT SOLUTIONS.
