The residency challenge to Rahm Emanuels mayoral candidacy moved across Washington Street to the 17th Floor of the Richard J. Daley Center today. A hearing was held this afternoon in the County Division which handles all election cases. Judge Mark Ballard presided yesterday and the Court will hear legal arguments next Tuesday, January 4, 2011. Once the court enters its final order, the ruling is likely to be appealed.
The Chicago Board of Election Commissioners has previously held that a mayoral candidate must satisfy the one year residency rule in order to run for office. Murphy v. Rosenburg, 88 EB-SMAY-6. That case is now a mere anomaly. [Hearing Officer] Morris, a former presidential appointee, placed great emphasis upon the fact that Emanuel had been serving as a presidential appointee during his extended absence from Chicago and did not, therefore, forfeit his residency notwithstanding the rental.
Cynics would point out the fact that Hayes was an obscure candidate while Emanuel is a powerful frontrunner and a celebrity. I think Jonathan Swifts sage observation remains relevant to any further discussion of the subject and expresses this same sentiment more gracefully and succinctly: Laws are like cobwebs, which may catch small flies, but let wasps and hornets break through.

One man had a place to sleep, the other did not. Guess who won out by playing "the Chicago Way?"
Laws are for the little people, silly
In Chicago Washington is not a street..its a Blvd. or an ex gay mayor.
We are morphing in to an oligarchy of sorts.
Thank you for not caring.

Thanks PBRCat. The Obama reelection machine needs Illinois, and that means they must run Chicago.
You can have kakocracy. It is my free gift to you and the world!
Can you imagine the egomania of owning words? ;-]
How about some company patenting YOUR DNA?
If you can pry it out of my cold dead hands... ;-]
Have a great New Years and the best to you and yours.
Washington Street is the correct name in the Loop. When you travel West towards the street becomes a boulevard.
