The Senate's Long, Twisted, Bumpy Road To Filibuster Reform

At some point on January 5, Sen. Tom Udall (D-NM) will take the Senate floor and begin a process that he hopes will end in the successful use of the "Constitutional option" -- the prerogative of a majority of the Senate's members to rewrite its rules on the first day of a new Congress.

He and his allies have been vocal about their plan. But the actual sequence of events that starts with him giving a speech, and ends with filibuster reform, is obscure, fragile, and extremely complicated. In fact, it's so involved that the "first day" of the 112th Senate could actually last for weeks.

About half way down the article, there's a "memo" that came from some unnamed (presumably Democrat) senate staffer. The memo outlines a "Possible Procedure" for this.

Actually, some "reform" of the filibuster rule might be good.

Making a filibuster actually hold up business while some minority objector bloviates for hours could avert some filibusters that are motivated by less than pure principles and convictions. The current rule, where the Senate moves on to other business when cloture fails has resulted in a lot more filibusters that don't seem to be based on real principles, rather meant to score political points.

And if anyone believes that "you'll be in the minority someday" will change the minds of any of the DemocRAT leadership, think again. If they can do this by simple majority now, they probably believe that they can undo it as lame ducks by simple majority as well. If the Republicans manage to get 60 votes, look for them to want to bring back a 2/3rds filibuster rule (requiring 67 votes to end debate). These people think they can get away with anything.

When the RATS lose power, they want to change the rules. The NM U.S. Senate delegation is almost as embarassing as California’s.

One would hope that the new republican majority in the House will put the screws to the democrats just the way that they did to them for the past four years.

There is probably a better than 50-50 chance that the Democrats will be in the minority in the Senate after 2012 election.
