(Idiot) Bloomberg slams lax laws that helped Arizona killer Jared Lee Loughner get firearm
NY Daily News ^ | 1/10/2011 | BY Erin Einhorn and Dave Goldiner

Buying the firearm used in the Arizona massacre was easy as pie for accused gunman Jared Lee Loughner, whose rampage is sparking a new debate over gun control.

The Bureau of Alcohol, Tobacco, Firearms and Explosives traced the 9-mm. Glock, serial number PWL 699, to a Sportsman's Warehouse in Tucson and confirmed - by store video and receipts - that Loughner bought it on Nov. 30.

Loughner passed an instant background check despite a drug arrest and history of erratic behavior. And thanks to a new law signed by Arizona Republican Gov. Jan Brewer, whose state has some of the loosest gun laws, Loughner was able to conceal it and carry it without a permit.

The law didn't fail, the existing laws weren't enforced.

13-3101. Definitions 7. “Prohibited possessor” means any person: (a) Who has been found to constitute a danger to himself or to others or to be persistently or acutely disabled or gravely disabled pursuant to court order under section 36-540, and whose right to possess a firearm has not been restored pursuant to section 13-925.

Usual MSM slam at the RTC law.

In AZ, they worked just fine. Anyway, if Loughner was set on killing Giffords, no law on the books would have stopped him.

Bloomberg is an asshat.

If the sheriff had done his job and reported the suspect to the courts, because he made previous threats, then the current law would have kept him from getting a gun legally.

Yeah, if that law hadn't passed, he wouldn't have been able to do the shooting. He could have never put that gun in his pocket because that would have been against the law.

Save us, Master Bloomberg, give us more laws!

Once again, political correctness, in my view raises it’s ugly head. The shooter was a known danger, at least to others, and was threatening to those who found themselves in his environment. His problems were brought to the attention of those in authority but they did nothing to protect society. This is a failure in our current system. When I was young, a person like this would have been institutionalized.

The new law had nothing to do with Loughner's ability to conceal and carry without a permit. The streets of New Yorka nd Chicago are filled with thugs who conceala nd carry without a permit.

Then he can lecture us about the evils of guns.

He bought the gun legally.

That in and of itself is not a crime in AZ the last time I checked.

That barb proves nothing about gun control.

Correct, the sheriff and the local prosecutor caused this, the knew the nuts mother and agreed to an alternative sentence and expungment for the drugs case. Because of that there was no conviction on his record.

Now here we have a guy that if the local law enforcement agency did their job would have denied this killer the right to purchase that Glock in the first place since he was known to have a history of mental issues.

Put the blame where it belongs,On the local Sheriff’s Dept, since they’re the ones who screwed up.

Mayor Bloomberge is forever stirring the anti-gun pot.You can be damn sure he has a paid security detail wherever he go’s.Unfortunately most of us working slobs can’t afford it so we need to provide our own security.

Exactly. There have been many accidents in the past year alone in which an illegal immigrant, driving without a license and while under the influence of alcohol was involved in an accident in which an innocent person died. Is that because our laws about driving are too lax? Is it because we don’t have laws about illegal immigration? No. It’s because the existing laws aren’t followed, are difficult to enforce, or just plain aren’t enforced. Don’t blame Brewer for this guy having a gun. That’s ridiculous.

Who is going to determine what constitutes ‘erratic behavior’?

The tragic actions of this communist-loving psychotic
scumbag will bring about an end to private sales of ALL guns (even though he purchased it legally at a gun shop). Better complete your collections soon.

despite a drug arrest and history of erratic behavior.

I gather the drug arrest had been expunged, but I haven't seen whether he was ever treated for mental illness. You can be crazy as a bedbug, but if there's no record of treatment, I don't see how you could show up on the relevant records!

I agree. According to news reports like this one. Loughner was deemed too dangerous to attend classes at Pima Community College, but so far as I have been able to determine the college reported his violent behavior to no one.

Politcal correctness kills again.

“”
In September, college officials sent campus police officers to Loughner’s home, where he lives with his parents, with a letter informing him he could not return without a mental health professional’s written assurance that his presence at college would “not present a danger to himself or others.” “”

I wonder if he intervened on behalf of Loughner's parents to prevent the information from being put into databases that would have blocked him on a background check.

I expect we'll see more discussion of what the law “allows” to be put into the background check data base for a gun purchase, and who is responsible for putting that data there

It seems that if this guy had uttered one peep against an airline and he'd have been on a no-fly list

one threat against an abortion doctor and Homeland Security would have been all over him

one threat against gays or mosques and the DOJ would have been into anti hate crime investigation mode

or one rant against obama and the secret service would have got up close and personal

but he has been stalking Congresswoman Gifford at least passively since 2007 and acting out extreme antisocial behaviors with no legal intervention whatsoever

"The new law had nothing to do with Loughner's ability to conceal and carry without a permit. The streets of New York and Chicago are filled with thugs who conceal and carry without a permit."

Not to mention Washington DC, which has stronger gun laws and a higher firearms homicide rate than any state.

In spite of arrests and multiple interactions with law enforcement, and in spite of being obviously psychotic, he was never involuntarily committed to a mental hospital and medicated. Why?

NCIS Index Brochure

NCIS criteria:

18, U.S.C. §922 (g) (3)

Is an unlawful user of or addicted to any controlled substance

18, U.S.C. §922 (g) (4)

Has been adjudicated as a mental defective or committed to a mental institution

It seems that he would have needed to be committed to a mental institution, but the drug arrests(s) should have triggered the NCIS.

My questions:

1. Why wasn't he committed to a mental hospital in spite of obvious psychosis and multiple interactions with law enforcement?

2. Why didn't the drug arrests trigger the NCIS?

This shooter has had a long history of strange outbursts. He was finally sent home last Oct from college & told he could not come back until he had a cleanance from a mental health evaluation.

This creeps “right to privacy’ & ‘confidentiality of his recorded bahavior” is the biggest reason why he got away with such actions for so long.

No one wants to admit their kin is nuts & needs to be removed from the streets & home town locations.

Further- NO ONE in LEo, such as the Pima Co Sheriff seems to think they MIGHT just have dropped the ball months ago with this kid.

This is Columbine on steroids.

There were plenty of signs of pending trouble. Laws ‘protecting’ the perp are harming the public.

So- why is this guy running loose?

IMO, this ‘sheriff’ has alot of answering to do to the people of Tucson.

Tell me, Mayor Bloomberg:

WHERE do all the gang members in NYC get their guns?

Do they buy them from a legal gun store & pass all the background checks?

For all the problems Arizona has with illegals, you have a bigger problem with same & with the gangs in NYC.

Sweep you own back steps, first, please. Quit grabbing the TV spotlight at every opportunity- especially when it doesn’t apply to you. You are starting to look like a media hungry Jewish version of NObama.

No, it was being a criminal in possession of pockets that enabled him to do that. For some reason I can't see him open carrying to the site where he was going to blast 20 people just because that was his only LEGAL carry option. Illustrating a related point:
