Wyoming Tackles Immigration

Wyoming is one of the many Western states that will be taking on illegal immigration this year.

Every Western state with the exceptions of Oregon and Washington have some type of bill under consideration that I am tracking. In Wyoming, Rep. Pete Illoway in the Wyoming House is introducing an Arizona-style immigration law. He describes it as a "clone" of Arizona's popular SB 1070 which has become a model for other states.

The bill would allow any state resident in Wyoming to file an action in court against a local government or police department for failing to enforce federal immigration law.

Unlike Colorado, Wyoming has a Republican governor and a Republican controlled state legislature. The chances of copycat legislation passing here are much more favorable than elsewhere.

The same basic constituencies are opposed to the bill.

This is true wherever you look in America: the cheap labor lobby, business organizations, so-called "human rights" organizations, the clergy, "progressives," and the mainstream media are solidly opposed to restrictionist immigration reform.

Whether it be Colorado, Wyoming, or Mississippi, the public is of its own mind about the issue.

In Wyoming, the nouveau rich depend upon the exploitation of cheap illegal labor in the Jackson Hole area to power the local economy and undercut the wages of Wyoming natives. These seasonal parasites jet in to resort towns to ski down mountain slopes and fly out to Hollywood or wherever they happen to live when they are done.

Unsurprisingly, "progressives" line up solidly behind the rich and their neo-feudal plantation economy in the Interior West, and against the working class of Wyoming. Colorado has the same problem, but to a much greater degree.

Go Wyoming! We need more states to enforce the laws on Illegal Aliens. All Illegal Aliens need to be deported....all supporters of Illegal Aliens need to be in jail.

Interesting article; my daughter and her family live in Jackson Hole; I have visited there many times, and the part about the ‘fly-ins’ is spot on.

We will not solve the illegal immigration crisis until business stops its ‘wink-wink, nudge-nudge’ practice of opposing illegals in public but then hiring them.

May God and freedom speed their course in Wyoming . Our nation needs to be secured from this demographic invasion. The neo-feudalists slavers who power the dymamic must be routed politically, and our constitution resecured.

I love the concept, but the execution of a statute permitting suits against local governments for failure to enforce any law is a slippery slope and one the Supreme Court has repeatedly struck down. Wyoming is not a border state. If the Fed’s fail to accept the illegals, there is no mechanism for removing them from the state. This leaves the police with little choice but to catch and release.

The only real way to attack this is to penalize salaries in any government program, including schools, that is identified as knowingly providing services to illegal clients. Failure to inquire is not a defense. A sharp salary reduction for teachers and administrators could very well help their grasp on reality. Social workers without licenses or jobs get to look for meaningful employment and compete directly with the illegals. It looks like win win to me.

'Preciate the good work you're doing following these bills. We've got something else forthcoming in Wyoming that'll cause the foreign invaders to be less happy, but I'd rather not spill it in a public forum. I hear tell those folks just love surprises.

Concur. However, one avenue of approach is to note that in Wyoming, In 2008 the voters approved and the Governor signed, an amendment [ Amendment "A" to the Wyoming Constitution rewording the oath of office for all state and county governmental office holders. The oath for police officers in the cowboy state is essentially the same:

Article 6, Section 20. Oath of office; form.

Senators and representatives and all judicial, state and county officers shall, before entering on the duties of their respective offices, take and subscribe the following oath or affirmation: "I do solemnly swear (or affirm) that I will support, obey and defend the constitution of the United States, and the constitution of this the state, of Wyoming; that I have not knowingly violated any law related to my election or appointment, or caused it to be done by others; and that I will discharge the duties of my office with fidelity."

It now requires only an additional state legislative act making a violation of that oath by such officeholders or law enforcement officers in the state making a failure to enforce the immigration laws of the United States and the State of Wyoming a specificied failure *to discharge the duties of my office* as described by the oath, and, thereby, a felony act of perjury which makes the officeholder ineligible to continue to maintain their office, nor to ever again hold any office or position of public trust in the State of Wyoming.

I do not believe that the Supreme Court would uphold a decision permitting perjury of a sworn oath to the constitution, but I do know of a way to find out.
