Ga. woman gets $1.2 million for coffee scalding

BUFORD, Ga.— A Cobb County jury has awarded a Buford woman $1.2 million after she said she was scalded by 190-degree water that shot out of a cappuccino machine at a QuikTrip convenience store.

Lawyer Nelson Tyrone III says the woman, 52-year-old Cynthia Nance, was burned on Halloween night in 2007 at a QuikTrip convenience store.

Atlanta attorney Valerie Pinkett, who represented QuikTrip, said the case was settled on confidential terms after the jury's verdict. She said the machine involved has been replaced with a newer model at all QuikTrip stores.

Tyrone said Nance was burned on her hand and arm as she held her cup near the machine. He said she could require an electronic implant to correct nerve damage caused by the burning.

GIVE ME A BREAK. If I had a nickel for the numbers of times I've been burned by coffee at restaurants and gas stations, well, I'd have heaps of nickels. An electronic implant for 190 degree coffee? Suck it up, lady.

Another shining example of how the lawyering profession is making life better all around.

Ah, well, there used to be talk of tort reform.

Actually, a common sense clause would be fine.

But hard for lawyers to get their minds around.

After the blood sucking lawyer gets his, she will end up with a lot less. Even though she shouldn’t get anything.

A former AF acquaitance of mine came away with only a nickname after spilling his hot Burger King coffee in his lap on his drive into work one morning. Crotch earned his nickname at roughly the same time McDonald's was being sued by Liebeck for her stupidity.

Granted, this woman appears to have been burned by a defective machine, but $1.2M is BS.

I retrieved my All-Clad saute pan from my Blue Star range on Saturday night without a hot pad.

The PAN burned MY hand because the Range was TOO HOT!

And the Heineken I was drinking at the time deadened my reflexes burning me further!

Where is Jackie Chiles when we need him?

“she shouldn’t get anything”

Really? You think she shouldn’t get anything at all?

Man if I had permanent damage of ANY sort from some dumbass contraption, I would want somebody’s ass on a platter. But since that would not be available, I would damn well want some cash.

Would it? So she goes bankrupt. No biggie to her I think.

It might be a slight disincentive, but not a panacea

It depends, if she walked up to the machine, pressed the button as she was supposed to, and was rewarded with serious burns requiring medical treatment and causing permanent bodily damage, then somebody’s gotta pay up. The amount seems a bit high though, unless much of it is medical treatment or the injury keeps her from working in her profession.

If she doesn’t have attorney’s fees the attorney wouldn’t take it. He would only take it if he thought/was sure he could win.

Another parasitic lawyer gets even richer.

Another clumsy twit injures herself and gets rewarded for it.

Every convenience store coffee drinker in the country gets to pay more every day to cover the liability for caffeinated and decaf HazMat.

The libs would call the verdict a win-win-win for their team.

This just plain SUCKS!!!! but it happens every day.

Every business seems to have a sign on the door that says SUE ME! We are nothing but a target.

We live in a world where some bustard can walk through the door and declare we owe him for something. Think about it, you are at risk on a personal basis for someone coming onto your property, slipping on a step and suing you for all you own. It could happen.

I don’t allow anyone on my property without them having a good reason to be there.

She did NOT injure herself, she was neither clumsy nor a twit.

The machine malfunctioned and injured her, causing permanent nerve damage and severe burns as it doused her with scalding water.

Quik Trip should have first started their offer with free coffee at all their quik trip stations, for life. Then paused to see if this dumb cluck of a woman would have said “Deal!”

You forgot:

“Cup not intended for consumption, eating it may cause internal injury or death. Remove spoon or any spoonlike device from cup before drinking, or severe eye damage/ blindness may result. Hot coffee should not be snorted up nostrils like cocaine, as sinus damage or burns may result. Likewise, coffee should not be inhaled into the lungs, as drowning and death may result. Also, coffee should not be squirted out of the mouth at potentially armed passersby, who may beat the crap out of you or murder you and toss your worthless stupid carcass in a ditch to rot.

We’re just saying.”

I’m not a coffee drinker, but where is this going? 110 degree coffee instead of 190? I’d think you’d want coffee on the hot side.
