Judge Holds Interior Dept. in Contempt Over Ban (Gulf drilling moratorium)
AP / ABC ^ | 2/2/11 | MICHAEL KUNZELMAN

Posted on 02/02/2011 6:54:47 PM PST by coaltrain

The federal judge who struck down the Obama administration's moratorium on deepwater drilling after the Gulf oil spill held the Interior Department in contempt Wednesday, and ordered the federal agency to pay attorneys' fees for several offshore oil companies.

"Such dismissive conduct, viewed in tandem with the reimposition of a second blanket and substantively identical moratorium and in light of the national importance of this case, provide this court with clear and convincing evidence of the government's contempt of this court's preliminary injunction order," he wrote.

When the libs lose the judges, they have REALLY overstepped the boundaries.

Get judges to legislate from the bench — that feeds to their egos. Flip them off by blatantly ignoring their rulings — that attacks their egos.

Contempt?
Usually when someone is found in contempt of court they’re put in prison for a little while.
Perhaps the Secretary of the Interior — Ken Salazar — should be jailed?

There should be consequences for violating the oath of office, which is to uphold and defend the Constitution.

Trying to pass unconstitutional legislation should be criminalized, and violators imprisoned and fined.

The reason the CPUSA is out of control is because the Washingtonians are scared of the McCarthy tag.

Time for McCarthyism on steroids, and lets not spare the propagandists in New York.

Another slap down to the narcissist.

Now for the Congress to ‘get some’ and strike down ‘bummers traitorous shut down of our space program.

The Space Program is LEGALLY under the auspices of CONGRESS - not the WH. ‘bummer had NO right to usurp Congress.

‘bummer's attack on the Space Program is putting up to 100,000 people out of work.

We need to email our reps and demand they rescind ‘bummer's illegal actions against our Space Program - and remind them it would be a great jobs-move AND help the disastrous housing in Florida which is going to cause many thousands to lose their homes, due to the extra blow from all but closing the Space Station.

These blows refuting 'bummer must be putting a burden on his handlers. Keeping a narcissist, who can't brook opposition, in line, is no easy task.

Right, 0bama and crew could care less about wasting tax dollars paying fines. I wish the judge would have thrown Salazar in the clink and done it when Salazar wrote the second moratorium days after the first ruling.

Yeah, that'll hit 'em right where it hurts...right on their earnings. Watch the "federal agency" share price sink on this ruling! /sarc

Great, malfeasance, and probably unlawful behavior, by a federal agency results in the equivalent of a fine -- paid with OUR tax dollars! Instead, the judge should send a bunch of the bastards to Sing Sing for a long, long time.

Thanks AAC! Ronald Reagan's legacy lives on.

How can we raise awareness of the damage being done to our energy industries? OPEC can't hold a candle to the treacherous bastards! If not the EPA, it's the Dept of Interior; if not them, Dept of Energy; if not them, the BLM, etc. At every turn energy exploration companies, developers and suppliers are getting thwarted or worse, shafted by the feral government. All the while bemoaning our dependence on foreign sources. WTH???

The federales can't possibly be this stupid, so one can only assume their actions are designed to kill domestic energy production. To what purpose? What do these home grown commies hope to accomplish by destroying several more major domestic industries? This is treason beyond description.

The federal judge who struck down the Obama administration’s moratorium on deepwater drilling after the Gulf oil spill held the Interior Department in contempt Wednesday, and ordered the federal agency to pay attorneys’ fees for several offshore oil companies.

Yup, and this is an example of what Vinson should have done:

U.S. District Judge Martin Feldman yesterday granted a preliminary injunction, halting the moratorium. He also “immediately prohibited” the U.S. from enforcing the ban. Government lawyers told Feldman the ban was based on findings in a U.S. report following the sinking of the Deepwater Horizon rig off the Louisiana coast in April.

Do you understand the difference? Feldman granted a preliminary injunction. Vinson didn't.

That's a big difference. Violation of an injunction carries real penalties, including prison if the judge chooses.

Vinson did state that an injunction wasn’t necessary,
as the law was now void,
and he had the expectation that the Executive would comply with the law.

Now, who’s gonna enforce this compliance?

Now, who’s gonna enforce this compliance?

Therein lies the problem. Vinson expects that the Obama administration would comply with the law. But, without the injunction, there's no way to enforce compliance.

So, they are free to ignore him, with no consequences. Maybe he'll impose an injunction, then. But, given the rules of jurisdiction, the administration can simply avoid doing anything in the northern district of Florida, and there won't be a plaintiff that can show injury by non-compliance.
