Man Facing Charges After Beating Officer at Fayetteville IHOP

Two Fayetteville police officers were injured after a fight at IHOP in Fayetteville.

Police said officers responded to the business before 3 a.m. Wednesday after employees called about an intoxicated customer.

Officers attempted to arrest Hiram Graham, 35, of Fayetteville. Officers applied one handcuff before Hiram yanked his arm away and tucked it into his torso. Police attempted to use a taser, but it didn't work properly.

Shortly after, Hiram's brother, Joemo Graham, 33, began a physical fight with an officer. Police attempted to deploy another taser.

Hiram was able to grab an officer's baton. According to police reports, Hiram struck an officer repeatedly on the head, spine, torso, and extremities. The officer suffered an eight-inch gash to the top of her head. She also had a cut on her lip and multiple bruises. Another officer received minor injuries during the incident.

A witness grabbed Hiram's arm, stopping him from hitting the officer. The officer took out her gun and threatened to shoot Hiram. At this point, police were able to arrest the Graham brothers.

Hiram is charged with attempted capital murder, aggravated assault, battery 2nd degree, resisting arrest, disorderly conduct, and public intoxication. Police say use of a police baton is considered lethal force when it's used to hit the head and spine.

Joemo is charged with battery 2nd degree and hindering apprehension. Hiram and Joemo were taken to the Washington County Detention Center.

The officer hit by the baton was taken to a local hospital. She had a large, open injury to her head, which required multiple staples to close. She also received stitches on her chin. The second officer was treated for cuts, scrapes, and bruises. Both officers were treated and released.

Why did they send a policewoman to the site of an unruly man, especially a big one like this? This is political correctness taken to the sillieth power.

Too bad these monkeys didn’t get double-tapped.

Arkansas law is lenient for the LAWFUL use of deadly force when defending a 3rd party. A citizen would have been justified in plugging the guy as he beat her on the skull, however, could have put them in peril from the other Officer whom might have taken the act of a good Samaratain as a further attack on the officer.

I would have taken the shot if I were Off. Lindley.

The officer took out her gun and threatened to shoot Hiram.
She sure has a hell of a lot more discipline than I do.
If that was me, I'd be radioing to the medical examiner's office to come pick up two bodies.

Guess they slept thru the ‘How to make an arrest’ lesson. Oh well...nothing like a beating to get the lesson driven home. So sad too bad.

I saw a video a few weeks ago about some Amish women who got into a brawl at IHOP. One of them clocked another one over the head with a coffee pot so hard the pot burst.

If the baton to the head is considered lethal force then I guess that makes it attempted murder of a police officer versus felony assault. That will buy you LOTS of time behind bars. See ya Hiram you worthless POS. Fayetteville is my new home so I’m glad I won’t be seeing you on my streets for a long time.

Great escalation of force by officer. Too bad she didn't plug the guy. Like you, If the ASP was in the "swing" position, I would have emptied the magazine into the idiot.

Maybe President Obama will give her the "couragous restraint" medal since she didn't kill obvious Obama voters ;0 ??

What they slept through was the 3-1 ratio they should have had. Should have been minimum of 6 cops there unless there was some sort of immediate danger.

My point exactly. Instead of replying on training they decided ego would carry the day. What they found were 2 angry black guys ready and willing to fight added to over reliance on their toys = 2 beat to a pulp COPs. Some of life’s lesson have to be learned the hard way. So be it...

So there was more than one cop on scene, two tasers have failed, the perp is beating the officer senseless - and no one shoots the MFers?
Un-freakin-believable.
