(CNN) -- A sailor is accusing the Navy of baselessly trying to discharge him for "unprofessional conduct" in an effort to get around the recent "don't ask, don't tell" repeal, after being found asleep in the same bed with another male sailor.

Actually it would. Sexual fraternization, while it happens, is frowned upon, as a breach of order and discipline.
Adultery is also routinely prosecuted, using the Uniform Code of Military Justice.

My father was a Navy man. Joined the reserves in 1928, active duty 1941-46, Pearl Harbor survivor.
He said that one of the reasons the Navy didn't want homosexuals was because the other guys would throw him off the ship into the ocean. The ban was for the man's own good.

In the army, females were not allowed in the barracks unless they checked in with the duty NCO but had to wait for the NCO to call the soldier downstairs............Under NO circumstances were females allowed in the barracks.

How has the Navy handled finding a man and a woman in bed together with the same claim? Provided of course the command has been notified. I suppose some PO’s might turn a blind eye in that case. If they dismissed them from the service then the guy doesn’t have a leg to stand on. If they gave them some other form of NJP then it’s going to get sticky and in today’s climate he’s going to walk.

Probably not much longer. If homosexuals get bed rights, then Commander Billy and Suzie Sailor are soon to follow. It happened with amoral corporations and governments here in the states. Fraternization among enlisted personnel, is still illegal, regardless of who does it with whom.
