SACRAMENTO, Calif -- SACRAMENTO, Calif. - Many same-sex couples are getting a tax break this year from the IRS, according to new requirements to report their combined income on federal tax returns.
Under "income splitting," the IRS is requiring all same-sex married couples or registered domestic partners in Washington state, California and Nevada to divide their combined income equally and report it on their separate tax returns.
For some couples, it will mean more money in their 2010 refund; for others, they'll pay more in taxes.
Either way, the change is significant, both monetarily and emotionally, officials of Lambda Legal, the national gay and lesbian legal rights group, said Tuesday in a conference call with reporters.
Peter Renn, a Los Angeles-based Lambda attorney, hailed the new IRS requirement as a money-saver for many same-sex couples, as well as another step to "move the ball forward" in recognizing their rights.
Those who will save the most are same-sex couples with the biggest disparities in income. For instance, a couple where one earns $100,000 and the other is a stay-at-home spouse with little or no income, will split their combined community earnings on their individual tax returns, with each reporting $50,000 in income. The result: an overall lower tax bill for both.

If it means reduced federal spending, anything that reduces the amount of cash going to the feds is a good thing.
Imagine that, more of that there blind justice, all are created equal, political directive stuff again, eh?
Why don't they just cut to the case and fund roadside bulletin boards that state "Vote democrat and qualify for a discount".

Now, how is the IRS going to verify the accuraccy of these returns???
There won’t be any supporting paperwork, no W-2’s, no mortgage statements, no dividend records, no medical bills tying out to the amount on the returns.
It’s open season for fraud and unreported income.

Same-sex couples, being childless mostly, deserve more than just the tax breaks that families-with-kids enjoy. They deserve all the incidental benefits too: someone to visit them and take them to dinner on holidays, someone to care for them in old age, someone to take their last name, someone to remember them when they’re gone. So, let’s propose a new federal law mandating all of those things for same-sex couples.
And since same-sex couples earn more on average (I believe) than opposite-sex couples, let’s tax the same-sex couples for the difference, and distribute it.

A little more seriously, how does the IRS just make rules for this? It seems like the definition of marriage for federal tax purposes would be determined by Congress instead of just some bureaucrat in the IRS building.
Do they also suffer the marriage penalty?
