An NBCUniversal marketing executive arrested in the shooting death of friend and colleague was free on $1 million bail today.
David Andrew Amstrong, was charged with murder Thursday in the March 18 shooting death of Brian Russell Kaplon, 32, a digital distribution executive with NBCUniversal.
Kaplon died from at least one shot to the chest, fired from an AR-15, a semiautomatic, civilian version of a U.S. military's M16. Most fire .223-caliber bullets.
The shooting happened in the garage of Amstrong's Porter Ranch home in 20000 block of Vercelli Way about 12:45 a.m., after both men allegedly had been drinking at a St. Patrick's Day party at Armstrong's.
Authorities said Armstrong kept a collection of guns in the garage.
There were no witnesses to the shooting, and it was unclear what Armstrong may have told detectives.
Court papers say filed Thursday say Armstrong "personally and intentionally discharged a firearm ... which caused great bodily injury and death to Brian Kaplon."
Armstrong, 32, is due in court April 12. It was unclear if he had a permit for the weapon, which is considered an assault rifle under California law.
An attorney for Armstrong said the shooting was accidental.
"There was no intent ever to harm his best friend. This was an accident based on two friends who were drinking and not following the proper safety precautions in the handling of a rifle," James Blatt told the Los Angeles Times.
He said called 911 after the shooting and tried to save Kaplon.
Kaplon was married with a child and twins due in May.
Blatt said the two families were close.
"They were best friends since fifth grade. They were like brothers. Wives were very close. Each family was an integral part of the other family's life."

I knew a guy down the street that kept a really big gun safe in his very nice garage at his very nice house. I am not sure if he had an insulated garage door but better to put the safe in the house.

Shocking as it is for the press to get something about guns correct, they did manage to get this one right... Most DO fire .223 caliber bullets (they even got this part right), although some fire the 6.8mm, as well as other cartridges.

Strange, I have an AR-15 and enjoy drinking, but have never even considered pointing my AR-15 at a friend while drinking. Drinking and shooting are two entirely separate avocations.
Of course, I’m not a moron working in marketing at NBC Universal.
A detached garage can certainly be built with climate controlled rooms attached. I have a garage like that but I don’t use the rooms for guns... I swear....

How picky do you want to get? They're NOT identical. While it's usually safe to fire a .223 round in a weapon chambered for 5.56x45mm, it's not always safe to do the reverse, according to SAAMI.
It's VERY important to know if your AR-15 is chambered for the .223 Remington or 5.56mm NATO round. And according to a couple of gunsmiths I know, many of the earlier AR-15s sold commercially were chambered for .223 Remington, though that's less common today.
so what you are saying is that it ISNT safe to fire 556 round thru my mini 14 that is 223......
asked three people and they told me it was safe...I didnt think so....basic gun rules state fire ammo chambered for you rifle...
You got me to thinking about that myself, but then I always used .223 Remington factory or reloads through my Mini-14 (I didn't really shoot it very often, usually only at practical or 3 gun matches).
I did some checking, and found that while Ruger "says" their Mini-14 is chambered for .223 Remington, that you can also fire military 5.56 ammo as well in the owners manual, thought it might not be a bad idea to contact Ruger too.
My old AK-47 was considered an Assault Weapon. I decided to sell it because being on the Assault Weapon Owners List just made me future target for the Marxists that rule CA.
I purchased a CA Legal AR-15. It has a “fixed” 10 round Magazine that requires a tool for removal. In my case, it's a bullet button. I'll bet the rifle mentioned in the story was not an Assault Weapon, but a CA Legal AR-15.
The sheer stupidity of the Gun Laws in CA is staggering. I hope the cancer that is CA Liberalism doesn't spread throughout this country, though I fear it metastasized in November 2008..
I can't wait for the Tyrants in Sacramento to mention this case to end the proliferation of CA legal long guns.
