Court: Wal-Mart to Face Massive Class-Action Suit

A sharply divided federal appeals court on Monday exposed Wal-Mart Stores Inc. to billions of dollars in legal damages when it ruled a massive class action lawsuit alleging gender discrimination over pay for female workers can go to trial.

In its 6-5 ruling, the 9th Circuit U.S. Court of Appeals said the world's largest private employer will have to face charges that it pays women less than men for the same jobs and that female employees receive fewer promotions and have to wait longer for those promotions than male counterparts.

The retailer has fiercely fought the lawsuit since it was first filed by six women in federal court in San Francisco in 2001 and said it would appeal the decision to the U.S. Supreme Court.

The ruling "opens up every company in America that has employees to class actions like this," said Theodore Boutrous, the company's lead lawyer on the largest gender bias class action in U.S. history.

Look for hiring freezes and an end to Wal-Mart hiring people with no experience if these feminist vultures have their way. That means high school and single-mom girls will be excluded from job offers.

Luckily, this decision comes from the Circuit Court that is the most frequently overturned Circuit Court in the country.

I think the Supremes reverse 5-4, although Kennedy scares me.

Go to the UFCW Web Site. They have had a campaign against Wal Mart as far back as I can remember. They will use everything they can do against the retailer. They try to organize stores and almost always lose. I believe they were successful in one case and Wal Mart closed the store.

I hope they bring in a TON of other employees who say otherwise, and then counter-sue for $$billions

I know a woman who works there who went right to the top in no time (she was obviously upper-management material right from the start)

No kidding, I am truly sick to death of these leeches. Walmart is a great place to shop, prices are fantastic, I sure can get more bang for my buck there then I can from just about any other place.

Class action lawsuits are probably unconstitutional because the principle is that every case needs to rise or fall on the evidence of the individual plaintiff. It’s impossible to rule when there are essentially over a million plaintiffs, each with different evidence and experiences.

Maybe we’ll get lucky and this will go to the SCOTUS and class action lawsuits will be killed forever.

I’m a woman and when I read stories like this I immediately think of my own career choices and experiences: did these women ask for “family friendly hours” or even a family friendly career track? (I did, went part time for a decade to be with my children more, and paid the price professionally, but it was completely worth it.)

There is a price to be paid for family friendliness. . .

Got that right. Having a collective bargaining agreement absolves you of this sort of legal action.

(translation: you can freeely dis your female employees so long as they are all paying dues which can be laundered back to the Democrat Party)

I know someone who was a manager at Walmarts. He had to leave because after this suit was filed, a white man could not advance in the company. He was passed over for being the wrong gender and sex.

Certain metro transits have a policy to lock the bus doors if there's an accident to prevent just that.

Exactly.....if you've got deep pockets, you WILL be sued for fleecing by them.....count on it.

It doesn't matter what conjured-up/trumped-up allegations that are made, you just get an OJ Jury seated, and/or a Liberal Activist Judge.
