EPA changes regulation requiring milk spill plan from dairy farmers

Washington, D.C. -- The Environmental Protection Agency has agreed to exempt dairy farmers from provisions of the Clean Water Act, U.S. Sen. Charles E. Schumer, D-N.Y., said Tuesday.

The Clean Water Act since 1970 required dairy farmers to develop and implement plans on how to handle a milk spill -- the same sort of plan as oil companies had to develop for handling oil spills.

Schumer said the EPA claimed that since milk contained animal fat -- which is an oil -- the milk spills had to be treated the same way.

Schumer said he has fought this regulation because the intent of Congress in these regulations was meant to apply to toxic substances and companies like ExxonMobil and BP, and to oil, not a dairy farm and milk.

This is the biggest crock of bovine scatology I have ever heard. BP dumps millons of gallons of oil into the gulf and all over our beaches and the EPA are worried about some GD SPILLED MILK????

This is a perfect example of our government gone completely amok.

The EPA may have a time with this. Cows get used to being milked, and fed, at certain times and give down their milk then. Often they are so prepared to give down the milk that they are shooting streams of milk out of their teats before they get into the milk barn.

Even a PE major knows the difference between a food oil and a mineral oil. Most certainly the EPA is out exercise its newly Obama ordained power. With all the pain the EPA is about to cause, we best be prepared for a Preparation-H spill.

The EPA must be abolished! Regulating the environment is not an enumerated power granted to Congress in Article 1 Section 8 of the Constitution! That is a power reserved to the states or to the people per the 10th Amendment!

I’ll finish your sentence. “No use crying over spilled milk”.

However, it is strange that Schumer got into this issue unless his diary farmers promised him no more free govt cheese (i.e. campaign donations).

After all, Schumer has been sucking at the govt teat since he got into Congress so this is, indeed, an abberation.

As for the stupidity at the EPA, it knows no bounds, esp. under the present marxist leadership of Browner and Jackson.

The more important body of EPA regulations that affect how oil is disposed of or dealt with at sea (or the barnyard for that matter) rises out of a law Congress passed back in the 1970s to regulate quite a different matter.

The problem was you had nice beaches and gathering spots on shores along federally regulated waters (oceanfront, large rivers, certain lakes) and folks in motorboats would pull up just offshore and dump their nightsoil buckets into the local swimming hole right in front of everyone.

The law Congress passed would allow local communities concerned with the condition of their beaches (if not the propriety of folks just dropping trou to dump in front of an audience) to petition EPA to set up a zone of control where such emissions would be prohibited except by permit.

Next thing you know you had EPA telling Coast Guard to direct all small boats to cease carrying port-a-potties and to install permanent type toilets. These orders were issued under penalty of pain of law, confiscation of boats, imprisonment, fine, and maybe even keelhauling!

With the expansion of the national boundary from 3 miles to 200 miles, even large oceangoing vehicles suddenly found themselves in the range of these regulations ~ and EPA elected to attack scully work and began regulating what happens to cooking oil in pots used for frying fish!

It only got worse. By the time BP came along EPA was directing Coast Guard to prohibit oil skimmers from coming in to remove oil from the ocean ~ the problem being that the process involved also putting a small part of that oil right back into the ocean.

So, whatever EPA agrees to when it comes to the Clean Water Act you have to look closer and see what they're doing with the "dropping trou" zones! That's the basis of their regulatory authority over oil.

Read my post at 16. EPA is giving up nothing. The issue isn’t the Clean Water Act and this didn’t start with Obama.

Every agency of the government should be abolished so we can see if we want or need them. A few might make it back: the EPA is not one of them. Be interesting to see what those folks could do to make a living in the real world.

Your are right. Back in 1975, we were unloading barges on the Mississippi River with the Coast Guard just waiting for a single drop of oil to touch the water. I thought the Coasties had better things to do. They probably thought so too, but they were under orders. Now it is SOP.

EPA was another colossal Nixon mistake. We have been kissing EPA @ss ever since.
