The Obama administration is seeking to limit the importation of some shotguns via rulings made by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF.) ATF has issued a “Study on the Importability of Certain Shotguns” which provides the logical underpinnings for a ban of some weapons.

In Part 1 we looked at how the ATF defined “sporting purpose” to exclude the popular action and practical shooting sports. In Part 2 we saw how several features that would cause an imported shotgun to be banned are useful in home defense. In Part 3 we looked at how the unconstitutional Gun Control Act of 1968, which introduced the “sporting purpose” test for importation, came to be. In this final installation we’ll look at the implications of the current study on pistols, rifles, and domestic shotguns.

One factor that jumps out from the current ATF study is that it differs from the Clinton gun ban in a critical way. The Clinton ban looked at guns and said if it could accept a high capacity magazine and had any 2 other characteristics then it was banned... The current study says that any ONE item on a list, including a magazine that holds more than five rounds or a place to attach a flashlight so you can see the burglar in your home, and the gun is banned.

So the problem doesn’t end with shotguns.

The ATF is accepting comments on the report until the end of April, 2011.

Nothing like an executive agency determining through regulation an abridgment of Constitutional rights, eh?

In Iraq in 2003, we struggled with implementation of ‘military laws’ and the DoS came up with the provision that each household could have one *semi-automatic* AK for home defense. They just didn’t understand that the only place in the world you could get a semi-auto AK was in the US of A.

Cretins.

These same folks and worse are now writing Federal Regulation through Executive Agency privilege. That is Fiat.

The Regime can't get it done through legislation, so they just trot out the ATF to reinterpret the laws. Ya'll didn't think that with the whole Cloward-Piven thing screaming down the tracks that the Regime was going to ignore all of those pesky guns, now didja?

(AP) Senior officials in the Obama administration have indicated they will seek a ban on the import of assault shovels commonly used for gardening and home construction projects. A spokeswoman for the Dept of the Interior, Falial Al-Jubal, released findings today that indicate these spades are potentially dangerous and lethal. Last week, a 78 year old Missouri woman cut her foot while weeding her Petunia patch, requiring over 4 stitches. "These shovels simply have no legitimate gardening purpose," Ms. Al-Jubal said. An assault shovel is a cheap import that includes a rounded and sharp deadly point, a "pistol grip" handle, and short body which experts indicate is perfect for concealment and swinging in tight places (a tactic favored by garden and so-called plant militia groups). "We are going to work very hard to get these deadly implements off our lawns, and out of our sheds," indicated Ms. Al-Jubal.

That will definitely cut down on “shovel” ready jobs. Americans can look forward to the boom in burger jobs or Liberal “snow” and blowing smoke jobs by the RATs and RINOs in DC.

This will definitely create a crisis because Liberals desperately need their shovels to move the Obama manure.

It is very heartening to see that you are responsible and maintain your weapons fully disassembled. That plus not having ammunition in the same room is the safest way to store them. You are a very responsible citizen, that is obvious to all.

It is also a crime. Writing "regulations" with the punitive effect of law is violating the explicit limits on FedGov power in the Constitution. Congress passes the laws, the President signs off on them. The Agencies themselves do NOT have the power to do what they are currently doing.

Not just the BATFE, but the DoE, EPA, FCC, FAA, DEA, etc.... Are all doing it as well.

Voting will not stop this.

A well written op ed won't stop this.

A court case won't stop this.

In 1941 on the island of Crete, the locals sharpened the edges of their shovels in order to have a weapon which could be used against the German paratroopers. That Cretan resistance caused hitler to believe paratroopers were not a viable military tool.

BATF has WAY too much power. If ever there were a government agency that needed to have its budget seriously reduced, this is the agency. Gun owners shouldn’t have to live in fear of government — which they do.
