they are being charged with second degree assault. the one that turned herself in will get 3rd degree assault. That is a ticket and possible probation. no jail time. the other one will probably be sentenced to a year in jail and get parole after 4 months.
This has to be upgraded to a hate crime. If Eric Holder refuses, then he and Obama are through. I realize this type of black on white hate crime happens daily in this country, but this video has gone viral. There’s no way they’ll be able to slip this under the rug. This might be Obama’s “Sistah Soldjah” moment.

For kicking somebody in the head? That would be a real travesty of justice if it turns out that way.
They should both be charged with attempted kidnapping as well.
