In this case, it wasn’t the law that was in error, it was the police. They were arrested for “impeding an open business” and in that statute, there are two exceptions to the law, first, if someone is doing union activites, and second, if someone is doing something protected by the Constitution.

The cop screwed up when he arrested them, the charges will be dismissed, and hopefully they’ll learn a valuable life lesson. :)

In this case you are wrong. They were arrested for impeding an open business and that law doesn’t apply to preaching.

Absolutely, driver's licenses expire as do auto licenses. And there are time limits on auto registration, and address changes. So the state REQUIRES these transactions be accomplished in a time-limited manner.

Like, I always use the webby thing. ..beats going to the DMV and getting preached to.

That makes sense. But it was my understanding that the DMV had not opened for the day. It was NOT an open business.

So just calling it something else, in this case harassment, makes it OK for the government, federal or State, to do that which it is forbidden by the Constitution?

Actually, it does. If someone had been playing rap in the same instance as this guy he could have just as easily been treated the same.

Well the 1st amendment did not address the DMV either.Yes, I do have the right not to be harassed, that is not the same as being offended.If something is offensive to me I can either turn it off or leave the area, no harm done.If I have to occupy a space for a period of time waiting to do personal business, especialy in this case with the goverment, being forced to listen to someones religious views is harassment.

OK, if you’re answering my question, then you’re agreeing with me that the people in line are not being forced to be there at that particular time.

Therefore, it’s not a case of people being forced to listen to the pastors reading the Bible. That was my point.

The statute they were arrested on says that the law does NOT apply to Constitutionally protected actions, which preaching is. No ones rights were being violated.

Of course, that statement works against you just as easily as it works against him.

It's all about who gets to decide where someone else's rights 'end'.

You have defined it such that his rights 'end' in a place that is convenient for you, but deny him the right to define your rights such that your rights 'end' in a place that is convenient for him.
