Hinchey's wife charged with DWI

HURLEY — The wife of Rep. Maurice Hinchey was charged Tuesday night with driving drunk.

State police said Allison Lee-Hinchey, 49, of Hurley, was pulled over at 9:40 p.m. on Morgan Hill Road for allegedly failing to keep right, use a turn signal and stop at a stop sign.

She had a blood-alcohol content of 0.12 percent, and was charged with two counts of driving while intoxicated, a misdemeanor, state police said.

Lee-Hinchey works as a lobbyist for DKC and represents the Committee to Save New York, a pro-governor group that spent nearly $5 million in March and April.

She is scheduled to appear in Hurley Town Court at 6 p.m. on June 7.

Politics aside, how do you get charged with two counts of a crime when you only commit the crime once?

You can be charged for driving under the influence of an alcoholic beverage and/or drug. You can also be charged for having a blood alcohol content (BAC) higher than is allowed by law. Therefore, you can be charged and found guilty of two separate violations for one DUI incident.

DKC is a "public relations, marketing, and public affairs" firm. Here is its website, the "DKC News." They apparantly don't consider the arrest of one of their lobbyists to be newsworthy; Ms. Lee-Hinchey's big night out isn't mentioned.

That’s just ridiculous. Being over a certain limit is part of the evidence of the crime charged. If they were going to allow a jury to find one guilty of the lesser included offense that would be one thing(like a finding of guilty of manslaughter when the charge is murder)but you don’t charge the defendant with murder and manslaughter.

We have a lot of laws that are ridiculous. But, ridiculous or not it is the law.
