DENVER (AP) - Republican and Democratic lawmakers are challenging Colorado's strict and tax & spending limits in federal court.
The Denver Post reported that the suit would be filed Monday.
Among those challenging the Taxpayers Bill of Rights - or TABOR - are Democratic Rep. Andy Kerr of Lakewood and former Republican state Sen. Norma Anderson.
TABOR requires lawmakers to ask voters to raise taxes. It also limits the amount of tax revenue the state can keep and spend.
The suit alleges that it violates the U.S. Constitution's guarantee of a small-R "republican" government where elected representatives make decisions on behalf of voters.
The plaintiffs are being represented by Boulder attorney Herb Fenster, a Republican, along with two Democrats, former Congressman David Skaggs and former state Sen. Mike Feeley of Lakewood.
ruling class suing for the “right” to everyone else’s money...
It is black letter law in California already.
This suit doesn’t have a chance and any RINO that supports it (the suit, not the law) should be tarred and feathered and run out of town.
I am not a big fan of direct legislation from the voting booth but when the politicians just keep digging in and throwing money out of the People’s Till, what the heck is left to stop them? Elections even aren’t enough.
The plaintiffs have no standing. In addition, TABOR involves state taxation, not federal taxation. The plaintiffs are hoping for a Hail Mary in the USSC. If one of the conservative judges retired or died when the rats had control of the Senate and White House, a liberal USSC may take this case as an ultimate act of judicial activism.
Ridiculous - Are the plaintiffs stating that Florid’s tax laws are unlawful? LOL
OTOH. We Coloradans thought Romer v Evans would be a definite win for the good guys. USSC Justice Anthony Kennedy, saw it differently.
