Supreme Court orders California to release tens of thousands of prison inmates
LA times ^ | May 23, 2011 | David G. Savage

Posted on 05/23/2011 10:29:12 AM PDT by Mount Athos

The Supreme Court ordered California on Monday to release tens of thousands of its prisoners to relieve overcrowding.

It is one of the largest prison release orders in the nation's history, and it sharply split the high court.

In dissent, Justice Antonin Scalia called the ruling "staggering" and "absurd."

Now, he said, the majority were ordering the release of "46,000 happy-go-lucky felons." He added that "terrible things are sure to happen as a consequence of this outrageous order."

I think we need a wall between AZ and CA a lot more then we need the fence between the US and Mexico. Quick everyone, man the barricades.

Easy problem to fix!

California needs to outsource the holding of any non-citizen prisoners to their home countries. Pay Mexico a few dollars per day to host Mexican citizen prisoners, etc.

It would save a FORTUNE over paying American union wages to hold the same prisoners.

Lets see now....46,000 criminals released:

>No may issue CCW
No hi cap standard capacity magazines
no NFA items
no "assault weapons"....whatever that is
Liberal AG, Liberal courts, liberal pro-bono/pro-criminal attorneys,
No Taurus Judge pistol;........

Nevermind, I won't be moving to Paso Robles anytime soon.

This is what happens when “empathy” replaces “rule of law,” and when political ideology, not the fundamental principles of the U. S. Constitution, motivate those appointed as justices.

We could release and deport the illegals, if we had a border.

Or, we could brand the illegals on the forehead, release and deport them.

They didn’t say where they had to release them. Release them to Cuba, the way Cuba did to us years ago.

Amazing though 46,000 convicted criminals hitting the streets. I wonder how many are death row prisoners.

Don’t laugh, it wouldn’t surprise me in the least.

I'd extend that outsourcing to all their prisoners. It'd save a bundle and help out Mexico financially.

Or, alternatively, build the prison right there at the border with Mexico out in the desert. This would be a hard-times type prison, so it has plain food, no salsa, no corn tortillas, no meat ~ just beans, and corn fritters on Saturday.

There's a secure fence running many miles along the border from the South side of the prison. There's no way anyone can cross the fence.

There are NO LOCKS on the doors on the South side. In fact, the doors are always open, and as long as prisoners want to go out those doors they are free to do so.

Just inside the doors there are machinegun positions keeping out those who might try to enter the prison from Mexico. No matter how nasty a criminal might be he is able to just walk free by walking into Mexico just out the door!

Why do they need to be released? Why not move them to other prisons, maybe even outsource to other states?

California needs to choose - a $20 billion “speed rail” that only developers and politicians really want, or jails and prisons to house criminals.

And I will add, the federal government has been derelict. They need to send the states the cash costs of educating, providing health care, and imprisoning criminal illegal immigrants.

And some hold up CA as the bellweather of liberal compassion and progressive ideals.
I almost feel bad for the “good” people of CA - conservative, hard working, innovative, visionary - that
must suffer the liberal policies of majority. But, until good people get mad enough to rid their state of Feinstein, Brown, Pelosi, Newsom etal, they’re gonna have to just suck it up and vow to work harder next time.
The “Golden State” is in fact painted lead and sinking fast.

On the upside, maybe Charlie Manson will finally get out. After all he never actually killed anyone himself. It's not his fault his girlfriends were loony.

Or maybe poor Sirhan Sirhan will finally be let loose. He's served more time in prison than any other convicted murderer in California for shooting (allegedly) just one person.

And we have all those 'poor disadvantaged minorities' who are doing 30 years for selling a single Rock of Crack. I'd bet they've all found God in prison and can't wait to find a nice job and start life over. They'd prolly even vote Republican.

Then we have all those brown people who were discriminated against by prejudiced white juries just because they had a few gang tattoos on their face and neck from when they were young and impressionable. By now I'm suuuure they'd make upstanding citizens as they are all very religious and good family men. They too would prolly all vote Republican as in their hearts they're all extremely conservative.

Lastly, they can release all those misunderstood white convicts who are allegedly in that Aryan Brotherhood thing. I'm sure that they only joined that group for protection against the really mean guys. They're not really racist manic killers you know.

So all in all I think that 'The Wise Latina' and that Butch in a Black Robe made the correct decision. Yep. It's a good thing that that ex ACLU lawyer, Ruth Buzzy Ginsberg was there to steer the majority in the right direction.

These prisoners have rights too ya know. And living in cramped prisons is inhumane and just encourages bad behavior from these really nice people who were wrongly or unjustly convicted.

Every time a judge or other official makes a decision that puts a criminal back on the streets - that official should be held criminally responsible for ANY AND ALL crimes that released convict commits. Decisions have consequences.

CA has a population of about 36 million - releasing 36,000 prisoners is gonna dump about 0.1% chronically unemployable people onto the streets ...

Take about an 80% recividism rate, about 29,000 are gonna commit more crimes. If each commits 5 crimes before being convicted and returned to prison, about 150,000 additional crimes are going to take place. Say, 10% are violent - thats 15,000 !!!

Now, CA has been ordered before to release prisoners and has always been saved by the conservative Supreme Court [ironic, ain’t it]. You would think that CA would realize that sometime its luck would run out, like it did today ...

So, WHY didn’t CA build MORE prisons in the interim instead of spending money on social programs like a drunken sailor in a French whorehouse on “Dollar Day” ???

Should the State Legislature need to pass a bill to prioritize release of convicts, who should be first?

Those convicted of assaulting sitting judges?

Those threatening members of the judiciary?

Or maybe they should work to balance the budget by laying off bailiffs?

Difficult decisions.

Maybe prison budgets could be realigned to remove cable TV, etc. Return to prison labor. Chain gangs.

The Federal Government that has no money, must first take it from the State in order to give it to the State, minus a handling fee. Perfect.

I suspect this is just an end run around the 3 strike law.

Liberals hated this law (taking career criminals off the street)

They could not get the law over turn so they did the next best things. Quit building prisons and like an overflowing toilet let it fill up.

Then liberals do what liberals always do when they can not get public support for their views, they run to the courts.

How many innocent people will be robbed, injured or murdered when these thousands of criminals are let back loose in society.

How many millions of dollars will be lost because of these crimes and for the eventual (hopeful) prosecution of these criminals and sent back to prison (only to force more criminals out onto the streets).

California is broke and liberals have broken it.
