(Texas) Judge: Transgender widow's marriage to firefighter not valid (same sex marriage case)

A Wharton judge has ruled that the marriage between a Wharton fire captain killed in the line of duty and his transgender wife was not legal, an attorney in the case said today.

"It is our understanding, having read a draft order circulated by Judge Clapp, that he has ruled that any marriage between Thomas Araguz and Nikki Araguz is void as a matter of law," Mann said in a prepared statement sent by email a few minutes after 5 p.m., when the judge's office was closed

In his statement, Mann said he anticipated that Nikki Araguz's legal team would file an appeal.

"We anticipate successfully defending the court's ruling throughout the appellate process," the statement said.

Nikki Araguz has said she will appeal the matter to the U.S. Supreme Court and last week announced that she is opening her life to new scrutiny through a proposed television reality show to be called Being Nikki.

The lavender mafia continue to try to subvert state law by judge shopping. They are now pushing for an appeal to "recognize" some element of "same sex marriage".

There’s nothing to appeal. It was a same-sex marriage and therefore void in Texas. The judge is right.

If I’m not mistaken, they were also separated at the time of his death. Whatever money is available should go to his kids from his first wife - not to the current spouse, who is a fraud.

What "she" are they referring too? Factually Nick is a He. If went around calling my self a martian and I had my skin dyed green (or red depending on my sci-fi source) with little antennae surgically attached to my head, would media outlets start calling me a Martian?

As this ruling doesn't appear to be issued from the state supreme court, or a district court doesn't this case have to go through the normal appeals process? Or do men who have their genitals mutilated get a "direct to the USSC" card with their surgical procedure?

Here's a prior story confirming what you recalled: they were separated at time of his death.

The kids should get the benefits, not a freak who defrauded the firefighter. Even if he participated in the fraud, the marriage would still be illegal and void in TX.

Of note: she's parading around a CA birth certificate that says she's female and has been since birth because CA reissues them for transgendereds, rewriting the record of history. She got the reissue after his death.

Fraud, mistake, or illegality are all grounds for anulment.

this marriage is void as a matter of law

or at bets voidable as a result of fraud.

There is no dispute about the deception by this male upon another male.

I fully agree with you, but you have to wonder how, if the timeline is true about the “gender reassignment” surgery, the husband couldn’t know. But that’s irrelevant; two men can’t get married.
