A U.S. Marine who was killed when he was gunned down in his home near Tucson, Arizona, never fired on the SWAT team that stormed his house firing 70 times in a hail of bullets, a report has revealed.

The revelation came as dramatic footage of the shooting was released, showing the armed team pounding down the door of Jose Guerena's home and opening fire.

The father-of-two, who had served twice in Iraq, died on May 5 after the SWAT team descended on his home believing it was one of four houses associated with a drug smuggling operation.

Unfortunately, thanks to court cases in KY and IN, this will happen more, rather than less, frequently.

Does anyone know when the Oathkeeper rally is happening in response to this?

Another comment - if the cops shoot any more vets like this, the vets might just get together and figure out how to do something about it... beyond rallying.

What is wrong with our country? They burst into a home guns blazing on the flimsiest evidence and kill a law abiding citizen. Yet they make a major drug bust in a warehouse without any shots being fired and the druggies are out on bail within 24 hours and many never serve time.

Does the selective, random intensity of enforcement seem crazy to anyone else?

There should be another memorial at the University of Arizona stadium. Have Zer0 attend with teleprompter. Instead of 14,000 people, have it standing room only with 28,000 people.

I agree! But this liberal sheriff will go out out to protect his own. He could care less about the murder, rather it is more important to cover up for this crime! The majority of voters of Pima County are fools.

Question, why isn't the Republican Governor asking the State FBI to handle the investigation, instead of the police departments who actually did the killing?

Agreed. the SWAT team that let this brave man die, after protecting his family, should be hanged.

“When she encountered the SWAT team, ‘the only thing I told them was take care of him, take him to a hospital,’ Ms Guerena told ABC.
An ambulance reportedly arrived in a few minutes, but medical personnel were not allowed inside to see Mr Guerena for an hour and 14 minutes, the family’s attorney, Chris Scileppi, told ABC News affiliate KGUN.
In contrast, it took responders only 12 minutes to address Congresswoman Gabrielle Giffords, who was shot in Tucson in January, according to Mr Scileppi.
Mr Storie defended the SWAT team’s actions, saying, ‘They still don’t know how many shooters are inside, how many guns are inside and they still have to assume that they will be ambushed if they walk in this house’. “

ICBW, but it seemed like only 5 seconds between the knock and the break-in.

There were 27 seconds between the time of the siren and the door being opened. Enough time for the resident to get his weapon. There was another eight seconds before the first shot was fired.

He had to wake up, tell his wife to go to the closet, retrieve a weapon, take a defensive stance and identify his target....his safety was still on....unlike SWAT.

So they saw a man with a weapon.....and unload. Watch the coward that first runs away and then runs back so he can pull a trigger. They couldn't even be assed to determine if the wife had left with the kids. Is this your idea of professional police work?

So far, yes, it is crazy and depressing that I would like to see what charges were up for the man who got shot? Were those charges, or the man’s own records, serious enough that a SWAT Team needed to bust in and do the job?

It is really disappointing and sad that such an event like this happened, especially from the people whose job is to protect us domestically as well.

“Those two cases have nothing to do with what happened in Tuscon.”

Sure they do. While the Tuscon case at least involved cops-with-a-warrant, it was still cops breaking into a house, albeit legally.

The RELEVANT cases I mentioned will only mean that MORE COP HOUSE BREAK INS WILL OCCUR now that warrants aren’t needed in those states. Thus, more needless murders like this will occur.

Stop defending our horrible SCOTUS. They’re a bunch of big-govt-loving Police Staters.

I agree but the court case will hinge on the AR-15 - not if it was safteyed or fired - but that it was "pointed" at the SWAT team.

This is a very unfortunate situation and both parties are cupable, IMO.

Sure there was. How else is a disgrace of a man with feelings inadequatecies supposed to feel superior unless he weilds a gun and takes out "thugs" under the cover of law. If these "men" had any honor they would come forward admit their cupability and accept the punishment that society would give them. Instead they lie, they conspire to cover it up. That in itself proves the bad intentions of these low-life scum, big man wannabes.

The gubment and their jack-booted scum will keep pushing until there is a reaction that they will not be able to control and it will have very dire consequences.
